Recommended Action

 

Approve the Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida, and the City of North Port, Florida, for Story Walk at the Garden of Five Senses Park, extending the timeline to May 31, 2024, and authorize the City Manager or the Mayor, as applicable under the City Charter, to execute all funding documents after Legal review.

 

Background Information

 

The City has an existing Subrecipient Agreement with Sarasota County that provides the City of North Port with $20,000 in Community Development Block Grant (CDBG) funding for making capital improvements to the Garden of the Five Senses Park at 4299 Pan American Boulevard, North Port, Florida. These improvements consisted of the purchase and installation of 40 storytelling signs along an existing 1,970 lineal foot walking path that is accessible to people of all abilities.

 

Due to Hurricane Ian, the walking trail at the Garden of the Five Senses Park received damages which required a third-party contractor to repair.  Until these repairs were completed, the Story Walk Project could not move forward. The repairs were completed at the end of May 2023.  As such, staff requested and received Commission approval for the First Amendment to the CDBG Subrecipient Agreement between Sarasota County, Florida, and the City of North Port, Florida, for Story Walk at the Garden of the Five Senses Park, extending the completion timeline to September 30, 2023.  This allowed time for completion of the project as well as compliance with the grant requirements. Work on the Story Walk project is complete, and the reimbursement request is being prepared.

 

Since then, Sarasota County notified the City of North Port in the Fall of 2023 that there were contractual irregularities discovered by their legal team requiring new Contracts to be issued for all CDBG funded projects.  The new Contract includes a final revised timeline so that the Contract considers the final delay due to the above stated irregularities.

 

The Second Amendment to the Community Development Block Grant Subrecipient Agreement between Sarasota County, Florida, and the City of North Port, Florida, for Story Walk at the Garden of the Five Senses Park, extending the timeline to May 31, 2024, has been reviewed by the City Attorney and is legally correct as to form.
