TITLE: Approve Second Amendment to Agreement No. 2021-41 Professional Engineering Services for Cranberry Boulevard/Hillsborough Boulevard Intersection Improvements Design & Permitting for Lighting Design Modifications to Scope and Price with Kimley-Horn and Associates, Inc., in the Amount of $20,615.00.
Recommended Action
Approve Second Amendment to Agreement No. 2021-41 Professional Engineering Services for Cranberry Boulevard/Hillsborough Boulevard Intersection Improvements Design & Permitting for lighting design modifications to scope and price with Kimley-Horn and Associates, Inc., in the amount of $20,615.00.
Background Information
The following provides a chronological order of events regarding Agreement No. 2021-41:
• On March 22, 2022, Agreement No. 2021-41, Professional Engineering Services for Cranberry Boulevard/Hillsborough Boulevard Intersection Improvements Design & Permitting between the City of North Port and Kimley-Horn and Associates, Inc. was approved by the North Port City Commission.
• On October 24, 2023, the First Amendment was approved by the North Port City Commission. The first amendment included drainage design changes necessary to avoid land acquisition problems and increased the cost by $65,780.00.
• The design plans are currently 100% complete. Plans were submitted to FDOT to obtain a right of way permit due to work at the US-41 intersection. FDOT sent comments requiring lighting to be added to this intersection, work that was previously not included in the scope of this Agreement.
• The cost associated with this second amendment is $20,615.00. The lighting design changes requested by FDOT is included in the second amendment.
• September 2024 is the current anticipated completion date for the lighting design work associated with Second Amendment to Agreement No. 2021-41.
Approval of this Second Amendment to Agreement No. 2021-41 will bring the Agreement total to $475,555.00 and time increased by 90 days to accommodate lighting design changes.
The Second Amendment to Agreement No. 2021-41 has been reviewed by the City Attorney and is legally correct as to form.

Funding in the amount of $20,615.00 is available in Fiscal Year 2024 Road and Drainage District Budget, Project Number R20HCI, account number 107-5000-541.63-00.
Procurement
Professional Engineering Services were procured, for Agreement 2021-41, pursuant to Chapter 2 Administration, Article VIII Procurement, Section 2-406 - Professional services selection under Consultants’ Competitive Negotiation Act (CCNA), F.S. §287.055 of the Code of the City of North Port, Florida.
