Background Information
The following provides a chronological order of events regarding Ordinance No. 2024-10:
Ø Effective October 2, 2021: The Florida Legislature repealed subsection (15) of Section 255.065, Florida Statutes (F.S.). This subsection provided explicit exemptions from the Public Records Law for certain documents related to Public-Private Partnerships (P3) procurements made pursuant to F.S. Section 255.065.
Ø To provide consistency between the F.S. Section 255.065 and the Code of the City of North Port, Florida, staff has drafted Ordinance No. 2024-10 for the City Commission’s review and consideration. Ordinance No. 2024-10 includes the following:
ü Strikes references in the Code of the City of North Port Florida, Section 2-420 to subsection (15) of F.S. Section 255.065.
ü Other verbiage has been added/deleted to clarify Section 2-420 of the Code of the City of North Port, Florida.
Ø Section 2-420 of the Code of the City of North Port, Florida, establishes local procedures related to procurements for P3. Updated sections in the Code of the City of North Port, Florida, Section 2-420 P3 includes the following:
ü (c) Unsolicited P3 detailed proposals.
ü (e) Competitive review and negotiation of P3 detailed proposals.
ü (f) Public records.
Ordinance No. 2024-10 has been reviewed by the City Attorney and is legally correct as to form.
Pursuant to Florida Statutes Section 166.041(4)(c), a Business Impact Estimate is not required because this ordinance is required for compliance with federal or state law or regulation.
Information for Second Reading
At its regular meeting on October 22, 2024, at 10:00 a.m., the City Commission heard Ordinance No. 2024-10 and continued the ordinance to second reading on November 12, 2024, as presented.
