Recommended Action

 

Approve Amendment No. 1 to Work Assignment 2022-18PW.02 - Hurricane Ian Long Term Recovery Plan with Rostan Solutions, LLC., for an additional amount of $58,715.96, for a total cost of $211,888.66.

 

Background Information

 

On September 23, 2022, Florida Governor Ron DeSantis issued Executive Order Number 22-218, declaring a state of emergency for 24 counties, including Sarasota County due to Tropical Depression Number Nine, which became Hurricane Ian.  On September 24, 2022, Governor DeSantis issued Executive Order Number 22-219, amending Executive Order Number 22-218 and expanding the state of emergency to the entire State.  On November 21, 2022, Governor DeSantis issued Executive Order Number 22-268, renewing the state of emergency for an additional sixty (60) days. On March 17, 2023, Governor DeSantis issued Executive Order 23-60, renewing the state of emergency for an additional 60 days. On May 15, 2023, Governor DeSantis issued Order 23-104 extending the state of emergency for another 60 days. Subsequently, on July 13, 2023, Governor DeSantis issued Executive Order Number 23-139 extending the state of emergency for an additional 60 days.

 

On September 26, 2022, the City Commission adopted Ordinance No. 2022-30, declaring a local state of emergency and granting emergency authority to the City Manager.  In his emergency authority, the City Manager entered into the following Purchase Order, which constitutes a legal Contract:

 

Ø                     November 21, 2022:  The City Manager approved Work Assignment 2022-18PW.02 - Hurricane Ian Long Term Recovery Plan in the amount of $153,172.70 with a final completion date of 365 days from Notice to Proceed (NTP).

 

On June 14, 2023, Rostan Solutions, LLC requested an Amendment to Work Assignment 2022-18PW.02 to increase in the amount of $58,715.96 based upon updated consulting services related to the delivery method for the Long Term Recovery Plan activities. This Amendment includes updates to the total amount of services based upon updating estimates of services. Please note the original amount for the Work Assignment 2022-18PW.02 was a preliminary estimate of services.

 

Under the Agreement 2019-49, Work Assignments are used to administer the Contract scope of services for all emergency tasks related to disaster debris monitoring services and financial recovery management. This Amendment is presented to the City Commission for approval of the completion of the Agreement. Work Assignment 2022-18PW.02 was approved during Emergency Declaration and will be brought to the City Commission for ratification.

Financial Impact

 

Funds have been allocated in the Fiscal Year 2023 Road and Drainage District Budget, account no. 107-5000-541.34-00, Project No. IAN22. Road and Drainage District account 107-5000-541.34-00 will be reimbursed when Federal Emergency Management Agency (FEMA) reimbursement is received.

 

Procurement

 

Emergency standby Agreement No. 2019-49.01 was procured pursuant to Section 2-405 Competitive Sealed Proposal process of the Procurement Code. Work Assignment 2022-18PW.02 was issued as a Notice to Proceed (NTP) authorized under section 2-408 Emergency Procurement with the activation of Ordinance 2022-30 on September 26, 2022. Work Assignment No 2022-18PW.01 have, and will be, issued respectively under Agreement No. 2019-49.01 utilizing the hourly rates contained in the Agreement.
