TITLE:                     Approve The Traffic Enforcement Agreement with Lakespur at Wellen Park Homeowners Association, Inc. for Traffic Enforcement Services

 

 

Recommended Action

 

Approve the Traffic Enforcement Agreement with Lakespur at Wellen Park Homeowners Association, Inc., for traffic enforcement services.

 

Background Information

 

Florida Statutes Section 316.006(2)(b) authorizes the City to exercise jurisdiction over any private road or any road controlled or owned by a special district within the City’s boundaries by a written agreement. The community of Lakespur at Wellen Park Homeowners Association, Inc. (Lakespur) has requested a written agreement with the City.

 

The Traffic Enforcement Agreement (TEA) will allow police officers to enforce the State Uniform Traffic Control provision in Florida Statutes Chapter 316, as well as applicable provisions of Florida Statutes Chapters 318, 320, and 322. Lakespur has requested enforcement over the following roads under its ownership and control.

 

1.                     Luminous Avenue;

2.                     Peace Lily Path;

3.                     Sun Drop Street;

4.                     Moonflower Drive;

5.                     Tuberose Path; and

6.                     Buttercup Court.

 

Traffic enforcement performed by the City during routine patrol within Lakespur will be at no cost to the community. Lakespur, however, agrees to reimburse the City for all actual costs, if any, resulting to the City from emergency signage requirements, or other City costs related to the community roads.

 

The Traffic Enforcement Agreement has been reviewed by the Interim City Attorney and is legally correct as to form.

There is no cost to the City. Lakespur agrees to reimburse the City for all actual costs, if any, resulting to the City from emergency signage requirements, or other City costs related to the community roads.
