Recommended Action

 

The Planning and Zoning Advisory Board recommends that the City Commission approve Petition No. VAC-22-193 via Resolution 2023-R-08.

General Information

 

Richard Casa of Custom Pools by Precision, Inc., on behalf of the property owner Robert Earl Broadway, has formally submitted to the City of North Port a written petition to request a partial vacation of the platted rear 20-foot maintenance easement located on lot 46, Block 2148, 45th Addition to Port Charlotte Subdivision. The purpose of the vacation request is to allow the newly constructed pool, deck, and cage to remain in the 20-foot rear maintenance easement.

The subject property is developed and located at 2761 Newman Drive and encompasses approximately 0.245 acres.

Pursuant to Florida Statutes Chapter 177.101, an application has been made to the City of North Port to formally request a vacation of a portion of the platted rear 20-foot maintenance easement located on lot 46, Block 2148, Forty-Fifth Addition to Port Charlotte Subdivision.

The property owners published a legal notice of intent to vacate the easements in a newspaper of general circulation for two (2) weeks consecutively.

The affected utility agencies have been notified of the vacation request and, through written responses, have granted their approval.

The City Attorney has reviewed and approved Resolution 2023-R-08 as to form and correctness.
