TITLE: A Resolution of the City Commission of the City of North Port, Florida, Authorizing the Purchase of +/- 17.31 Acres of Real Property Located on Pan American Boulevard and Described as Portions of Sections 29, 30, 31 and 32, Township 39 South, Range 21 East, A Portion of Real Property Bearing Sarasota County Property Appraiser Parcel Identification Number 0996001000; Incorporating Recitals; Providing For Filing of Documents; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.
Recommended Action
Approve Resolution No. 2022-R-39, authorizing the purchase of +/- 17.31 acres of real property located on Pan American Boulevard bearing Sarasota County Property Appraiser Parcel Identification Number 0996001000 for the Utilities Administration and Warehouse Facility.
Background Information
On February 25, 2020, Resolution No. 2020-R-06, authorizing the acquisition of the Talon Bay property for the Utilities Administration and Warehouse Facility, was rejected, and Commission directed staff to re-evaluate properties previously considered as well as alternative properties not previously evaluated and recommended staff review possible alternative means of acquiring properties, such as a land swap.
Stantec identified four sites that had been previously evaluated along with one additional site suggested for further consideration and analyzed the five sites. During the City Commission Workshop held on December 7, 2020, Stantec presented the Addendum to the Site Selection Report to the Commission, which provided a summary analysis and ranking of the five properties under consideration. Based on this analysis, Commission recommended that the City Manager direct staff to move forward with negotiations for the purchase of the site identified on Pan American Boulevard.
On September 14, 2021, Commission approved a Due Diligence Agreement which would analyze the feasibility of use of the site for the future Utilities Administration and Warehouse Facility. Once the Due Diligence Agreement was approved, the City was granted access to the property to conduct environmental analyses, surveys, an appraisal analysis, as well as activities necessary to create a new site plan, calculate stormwater management requirements in accordance with the Southwest Florida Water Management District, conduct a preliminary biological assessment and any other activities the City deemed necessary to conduct its due diligence. The Due Diligence Agreement also granted the City the exclusive and irrevocable right of first refusal to purchase the property.
Once all due diligence was performed and two appraisals were obtained, Utilities coordinated with Arlena Dominick, Consultant Project Manager, American Acquisition Group for the negotiation and purchase of this property. An agreement has been reached with 5400 Group, LLC. to sell this property to the City for $2,900,000 for the Utilities Administration and Warehouse Facility.
Resolution No. 2022-R-39 has been reviewed by the City Attorney and is legally correct as to form.

Funding in the amount of $2,900,000 is available in account 420-6060-536.61-00 under project U18UAB.
Procurement
Purchase of property will be pursuant to Sec.2-403 (a)(3)c of the City of North port Procurement Code - Real Property, real estate brokering, or appraising.
