TITLE: Discussion and Possible Action Regarding the Termination of the Agreement Between the Kiwanis Club of North Port, Inc., and the City of North Port, Florida, Regarding Children’s Community Clothing Closet and the Approval of the Tenant Lease Agreement Between the City of North Port and Kiwanis Club of North Port, Inc. for $1.00 per Month for Space at the Al Goll Ancillary Building for Kiwanis Club Outreach Efforts.
Recommended Action
Terminate the Agreement between the Kiwanis Club of North Port, Inc., and the City of North Port, Florida, regarding Children’s Community Clothing Closet and approve the Tenant Lease Agreement between the City of North Port and Kiwanis Club of North Port, Inc. for $1.00 per month for space at the Al Goll ancillary building for Kiwanis Club outreach efforts.
Background Information
On September 28, 2022, Hurricane Ian destroyed the Children’s Community Clothing Closet (CCCC) portable unit. To support the continuation of this valuable community project, the City of North Port worked to identify a new location to administer the closet. In an expediated effort, an area within the Family Services Center (FSC) was remodeled to host the program to meet community needs. However, this unforeseen circumstance has required the Social Services Division to change the operations and administration of the program to correspond with the other functions occurring at the FSC. The Social Services Division is requesting to terminate the current Agreement between the City and the Kiwanis Club of North Port, Inc., for the operation of the Closet, executed in February 2022 pursuant to Section 11 of said Agreement. Additionally, approval of the attached Tenant Lease Agreement for space at the Al Goll ancillary building, is being requested. The space will be utilized by the Kiwanis Club of North Port, Inc., for their operation and outreach efforts, separate from the Children’s Community Clothing Closet.
The term of this Tenant Lease Agreement will be one (1) year (“Initial Term”). After the Initial Term, unless otherwise terminated, this Agreement will automatically renew from year-to-year thereafter, provided that in no event will this lease renew for more than four (4) consecutive terms.
The Tenant Lease Agreement between the City of North Port and Kiwanis Club of North Port, Inc. has been reviewed by the City Attorney and is legally correct as to form.
