TITLE: Ratify City Manager's Approval of Lease Agreement - Debris Management Site with Carlton Sarasota, LLC, Davis Sarasota, LLC, and Pallardy Sarasota, LLC, for Use of Land Located on Toledo Blade Boulevard for Debris Management Site Due to Hurricane Ian.
Recommended Action
Ratify City Manager's Approval of Lease Agreement with Carlton Sarasota, LLC, Davis Sarasota, LLC, and Pallardy Sarasota, LLC, for Use of Land Located on Toledo Blade Boulevard for Debris Management Site (DMS) Due to Hurricane Ian.
Background Information
On September 23, 2022, Florida Governor Ron DeSantis issued Executive Order 22-218, declaring that a state of emergency exists in Brevard, Broward, Charlotte, Collier, DeSoto, Glades, Hardee, Hendry, Highlands, Hillsborough, Indian River, Lee, Manatee, Martin, Miami Dade, Monroe, Okeechobee, Osceola, Palm Beach, Pasco, Pinellas, Polk, Sarasota, and St. Lucie Counties; directing the Division of Emergency Management to execute the State’s Comprehensive Emergency Management Plan; and authorizing each political subdivision within the State of Florida, pursuant to Florida Statutes Section 252.38(3)(a), to waive certain procedures and formalities otherwise required by law that are in the interest of the public health, safety, and welfare.
Subsequently, on September 26, 2022, the North Port City Commission adopted Ordinance No. 2022-30 declaring a local state of emergency due Hurricane Ian, granting emergency authority to the City Manager to issue Emergency Orders to ensure the safe conduct of necessary operations of the North Port City Government. The emergency authority granted to the City Manager during this state of emergency may extend beyond normal non-emergency powers.
Following Hurricane Ian, the City of North Port’s Disaster Debris Management Services company, Ceres Environmental Services, Inc, began picking up storm debris. Currently, Ceres Environmental Services, Inc has collected over 1.5 million cubic yards of vegetative debris and approximately 160,000 cubic yards of Construction & Demolition (C&D) debris throughout the City of North Port. As a result, the space available is surpassed at the City of North Port’s identified debris management sites.
Carlton Sarasota, LLC, Davis Sarasota, LLC, and Pallardy Sarasota, LLC, have agreed to lease 10 acres within their property located north of I-75 east of Toledo Blade Boulevard for vegetative debris management.
The Lease Agreement has been reviewed by the City Attorney as to form and correctness.
The City Manager approved this agreement under his emergency authority.

Financial Impact
Funding in the amount of $10,000.00 per month is available in the Fiscal Year 2023 budget, under Project Number IAN22, as reflected in account number 107-5000-541.44-00.
Funding in the amount of $60,000.00 per a minimum period of six months is available in the Fiscal Year 2023 budget, under Project Number IAN22, as reflected in account number 107-5000-541.44-00.
Procurement
The Exigency Procurement Form will be completed and submitted to Procurement before the Purchase Order is issued.
