Approve Construction Manager at Risk Contract No. 2025-09 - Phase I, Preconstruction Services Contract, to Wharton Smith, Inc. in the amount not to exceed $283,662 for Project WM19BR, Warm Mineral Springs Park Building Renovations.
Background Information
The Parks and Recreation Department in collaboration with the Purchasing Division issued Proposal (RFP) No. 2025-09, Warm Mineral Springs Park Historic Renovations, Floodproofing and Site Improvements Construction Manager at Risk Project. The RFP was advertised on November 4, 2024, on Demandstar and was broadcasted to 2,044 suppliers plus 13 supplemental suppliers. The RFP was opened on December 3, 2024, with three (3) firms responding:
Ø Burke Construction Group
Ø Jon F. Swift, Inc.
Ø Wharton Smith, Inc.
The Selection Committee reviewed and ranked the proposals, and recommended to enter into negotiations with Wharton Smith, Inc. After completion of successful negotiations, the Parks and Recreation Department is requesting the City Commission’s approval of Contract No. 2025-09 to Wharton Smith, Inc. for Preconstruction Services, Phase I of Project WM19BR Warm Mineral Springs Park Building Renovations.
Wharton Smith, Inc. will coordinate preconstruction services with recently awarded design and engineering services of Kimley Horn & Associations, Inc. Phase I is anticipated to be completed within one year of award.
The Construction Manager at Risk Contract No. 2025-09 - Phase I, Preconstruction Services Contract, to Wharton Smith, Inc. in the amount not to exceed $283,662 for Project WM19BR, Warm Mineral Springs Park Building Renovations has been reviewed by the Interim City Attorney and is legally correct as to form.

The renovations at Warm Mineral Springs Park in the amount not to exceed $283,662, is funded through Project WM19BR in Fund 125-3040 (balance $3,438,382.88), Fund 152-3040 (balance $382,625.00), and Fund 306-3040 (balance $4,807,413), with a total project available balance of $8,628,420.88.
Procurement
This service was procured pursuant to Chapter 2 Administration, Article VIII Procurement, Section 2-406 Professional services selection under Consultants’ Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.
