Background Information

 

The West Villages property, formerly known as Taylor Ranch, was annexed into the City of North Port over several years, beginning in 2001, with the final parcel being annexed in 2015. The West Villages Improvement District (WVID) was created on June 17, 2004, with enabling legislation in Chapter 2004-456, Laws of Florida for the purpose of financing, planning, and constructing infrastructure within the subject property.

 

During the City Commission Special Meeting held on March 25, 2020, the City Commission approved the West Villages Developer Agreement (Post Annexation Agreement). The parties to the Post Annexation Agreement were the City of North Port, the WVID, and the West Villages, LLLP (WVLP). The Post Annexation Agreement established detailed execution requirements for land dedication of various system improvements, and a method by which the developer would be reimbursed for certain system improvements by the City from impact fees collected within the development area and addressed Fire & Emergency Medical Services, Law Enforcement, Parks and Recreation, Solid Waste, and General Government.

 

On November 12, 2024, the City Commission approved the First Amendment and Restatement of the West Villages Developer Agreement (Restated Agreement). The Restated Agreement updates and restates stipulations to meet current level of service standards and the changing needs based on development patterns within the subject property.

 

The Restated Agreement outlined the conveyance of two (2) parcels from WVLP to the City for the development of needed government infrastructure as follows: 

 

 

Ø                     General Government Land:  Approximately ±.6037 acre parcel of land lying in Section 32, Township 39 South, Range 20 East, bearing Sarasota County Property Appraiser Parcel Identification Number 0783070090; and

Ø                     The Public Works Parcel:  Approximately ±20 acres of the 51.9 acre parcel of land lying in the south half of Section 34, Township 39 South, Range 20 East, bearing Sarasota County Property Appraiser Parcel Identification Number 0788010003.

 

The parcels are being conveyed fee simple and with marketable titles. Per the Restated Agreement, the City is to annex in the complete 51.9 acre parcel that contains the ±20 acre Public Works Parcel prior to constructing a facility on this parcel. The annexation will follow at a later date.

 

The Restated Agreement outlined the conveyance of one (1) parcel from the City to WVLP as follows: 

Ø                     The ±63 acre Park: This approximately 63 acres parcel was previously conveyed by WLVP to the City back to WLVP.  As specified in the Restated Agreement, WLVP has identified and reserved an alternate parcel for a potential sports facility parcel and the sports tourism park.

Resolution No 2025-R-21 has been reviewed by the Interim City Attorney and is legally correct as to form.

Financial Impact

 

Not applicable.  As per the Restated Agreement, the real property is to be conveyed to the City at no cost to the City and the City is not obligated to provide reimbursements for the land conveyed. In addition, the West Villages, LLLP, is to pay all applicable recording fees.
