Recommended Action

 

Approve Amendment No. 1 to Agreement No. 22PLN95 between Florida Department of Environmental Protection and City of North Port for a Vulnerability Assessment and Adaptation Plan to extend timeline, and authorize the City Manager or the Mayor, as applicable under the City Charter, to execute all funding documents after legal review.

 

Background Information

 

Pursuant to Section 380.093, Florida Statutes, the City of North Port received a grant to conduct a Vulnerability Assessment and Adaptation Plan to evaluate impacts on all critical assets and infrastructure susceptible to sea-level rise as modeled utilizing accepted means and methodologies. On August 24, 2022, Florida Department of Environmental Protection (FDEP) Agreement No. 22PLN95, became effective, and the City was awarded $200,000 to fund the development of the Vulnerability Assessment and Adaptation Plan. The project timeline and requirements were also prescribed via the FDEP Agreement.

 

On December 13, 2022, Commission approved Change Order No. 1 to FDEP Agreement No. 22PLN95 which modified and updated language in Attachments 1, 2 & 3 contained in the original agreement.

 

Amendment No. 1, modifies and updates language in Attachments 1 through 6 and Exhibits A, C, F, G, H, I and J contained in the original agreement. Amendment No. 1 also revises the timeline of the project as a result of Hurricane Ian and grants an extension to the agreement.

 

Amendment No. 1 to Agreement No. 22PLN95 between Florida Department of Environmental Protection and City of North Port for a Vulnerability Assessment and Adaptation Plan to extend timeline, and authorize the City Manager or the Mayor, as applicable under the City Charter, to execute all funding documents after legal review has been reviewed by the City Attorney and is legally correct as to form.

Financial Impact

 

The City of North Port Road and Drainage District will be reimbursed $200,000 by the State per Agreement No. 22PLN95.  Amendment No. 1 does not change the financial impact.

 

Procurement

 

Professional Engineering Services were procured pursuant to Chapter 2 Administration, Article VIII Procurement, Section 2-406 - Professional Services selection under Consultant’s Competitive Negotiations Act (CCNA), F.S. 287.005 of the Code of the City of North Port, Florida.
