Recommended Action

• Pros: Secures permanent, reliable access to the Cosmic Waterway area needed for future inspection, maintenance, dredging, and rehabilitation activities. Ownership eliminates reliance on private property owners for access, helping prevent delays and improving the City’s ability to manage and maintain the Cosmic Waterway long term.
• Cons: Requires an upfront purchase cost and places responsibility on the City for ongoing property maintenance, liability, and any necessary improvements.
Option 2: Deny Resolution No. 2026-R-18 as presented authorizing the purchase of real property located on Shorewood Street, North Port, Florida, 34288.
• Pros: Avoids the immediate purchase cost and eliminates the City’s responsibility for property maintenance, liability, and long-term ownership obligations associated with the lot.
• Cons: The City would continue relying on private property owners for access to the Cosmic Waterway, which may delay or limit needed inspections and maintenance. This could reduce operational efficiency and potentially increase costs or contribute to long-term waterway management challenges.
Background Information
The Department of Public Works is seeking to purchase real property located along the Cosmic Waterway, on Shorewood Street (Parcel Identification No. 0958066667), currently owned by Joseph Cacciapuoti and Deborah J. Cacciapuoti as co-trustees of the Joseph and Debroah J. Cacciapuoti Revocable Trust. This property acquisition will provide permanent access for future inspection, maintenance, and rehabilitation activities associated with the City’s water conveyance systems.
An appraisal report completed on December 2, 2025, by Hettema Saba, LLC, determined the property value to be $21,000.00. Public Works has worked with American Acquisition Group, LLC to facilitate the purchase, and the seller has agreed to sell the property to the Road and Drainage District for $23,000.00.
Resolution No. 2026-R-18 has been reviewed by the City Attorney and is legally correct as to form.
Resolution No. 2026-R-18 was provided to the City Clerk’s Office on April 24, 2026, for signature subject to City Commission approval.

Funding in the amount of $23,000.00 is available in the Fiscal Year 2026 Road and Drainage District Budget, account number 107-5000-541.61-00, Capital Project R22RDD.
Procurement
Purchase of property will be pursuant to Sec.2-403 (a)(3)c of the City of North Port Procurement Code - Real property, real estate brokering, or appraising.
