TITLE: Approve the Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida and the City of North Port, Florida for Pan American Blvd. Seawall Renovation, Extending the Timeline to August 31, 2024, and Authorize the City Manager or the Mayor, as Applicable Under the City Charter, to Execute all Funding Documents After Legal Review.
Recommended Action
Approve the Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida and the City of North Port, Florida for Pan American Blvd. Seawall Renovation, extending the timeline to August 31, 2024, and authorize the City Manager or the Mayor, as applicable under the City Charter, to execute all funding documents after legal review.
Background Information
The City of North Port has a Subrecipient Agreement with Sarasota County for the receipt and use of Community Development Block Grant (CDBG) funds for the Pan American Boulevard Seawall Renovation, at Jeffrey Lake, between Merrill Street and Safford Terrace. The grant will reimburse the City up to $100,000 for construction costs.
Due to Hurricane Ian and its impact on supply chains, there were delays in delivery of steel sheet pile and handrail. As a result, the City requested and was granted a timeline extension, setting a new project completion date for December 30, 2023. The initial timeline extension date is reflected in the partially executed First Amendment.
In the Fall of 2023, Sarasota County notified the City of North Port that there were contractual irregularities discovered by their legal team requiring new contracts to be issued for all CDBG projects. This is why the First Amendment granting the extension is only partially executed, as the irregularities were discovered after execution by the City, but before execution by the County. The Second Amendment corrects the irregularities and also extends the timeline, allowing for project delays due to various unforeseen site conditions, including a hard rock layer that needed to be predrilled before the sheet piling could be installed. The timeline for completion of the project is now extended to August 31, 2024.
The Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida and the City of North Port, Florida for Pan American Blvd. Seawall Renovation has been reviewed by the City Attorney and is legally correct as to form.
