Background Information
Hurricane Ian deposited a significant amount of debris within the Myakkahatchee Creek. This debris has created blockages that cause water to stage up in the creek during a rain event and worsen the flooding on adjacent roads and properties. The United States Department of Agriculture (USDA) National Resources Conservation Service (NRCS) provides public assistance funds for disaster response related debris removal and disposal operations. The City contacted NRCS for evaluation of the impacts from the hurricane and assistance to restore the flow within this essential waterway. In compliance with NRCS grant application and project requirements, the City advertised Request for Letter of Interest No. 2023-03PW to contract a qualified engineering firm to assess, quantify and map the blockages and obtain all permits necessary to remove the blockages in line with regulatory agencies’ requirements. Consor Engineering LLC (Consor) was awarded this assignment. Consor’s engineers completed a thorough evaluation of the Myakkahatchee Creek from Price Boulevard north to the City’s jurisdiction boundary and identified nearly 200 blockages.
During a Regular Commission Meeting on February 13, 2024, the City Commission approved a grant agreement with NRCS in the amount of $1,794,049.98 for the Myakkahatchee Creek Maintenance Access and Debris Removal project. The City is committed to a 25% match for this project, or a total of $540,376.50.
State and Federal agencies have completed review of this project and the City has secured required permits for the blockage removal project. All environmental considerations were identified in the project including field findings, wetlands, and other surface waters. A protected species survey and an archeological survey have been conducted. Another gopher tortoise survey will be completed within the required timeline prior to project initiation.
The City of North Port advertised Request for Bids (RFB) No. 2024-19 seeking responses from licensed and experienced Contractors capable of removing fallen trees and other debris blockages in the Myakkahatchee Creek. Bid opening was held on July 25, 2024, and three (3) bids were received from TSI Disaster Recovery, LLC., Rick Richards, Inc., and Arbor Tree and Land, Inc. Rick Richards, Inc. was the lowest responsive and responsible bidder.
Work shall commence on, or immediately following the receipt of the Payment and Performance bond and the issuance of the Notice to Proceed. The project shall be completed by March 31, 2025, as specified in the NRCS grant agreement, unless an extension is granted.
On November 4, 2024, the Department of Public Works presented information on this maintenance project to the Environmental Advisory Board, that presentation is attached.
Contract No. 2024-19 has been reviewed by the City Attorney and is legally correct as to form.

Procurement
This service was procured pursuant to Chapter 2 - Administration, Article VIII - Procurement, Section 2-404, Competitive Sealed Bid Process of the Code of the City of North Port, Florida.
This service complies with the provisions of 2 C.F.R. Section 200.317-27, as applicable. This project is subject to the requirements set forth in the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, 2 CFR Part 200. Proper documentation is required by the American Rescue Plan Act, per federal requirements and corresponding forms.
