• Pros: Moves the project forward on schedule utilizing a vendor selected through a competitive process with relevant experience that will provide a professional, cohesive approach for the City for storm repairs and future storm mitigation at the Hillsborough Booster Station and Myakkahatchee Creek Water Treatment Plant.
• Cons: Commits funds for this project that could potentially be used for other projects.
Option 2: Deny the Fifteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract Phase II by and between the City of North Port, Florida, and Jon F. Swift, Inc.
• Pros: Allows the use of funds for other purposes.
• Cons: Existing damage caused by Hurricane Ian will remain. Existing louvers and windows, which do not meet current wind-load requirements, remain in place for a higher likelihood of wind damage to the facilities from future storms.
Background Information
Due to Hurricane Ian, the Hillsborough Booster Station, located at 17113 West Hillsborough Boulevard, Port Charlotte, Florida, 33954, sustained damage to soffit and facia, which necessitates the removal and reinstallation of existing lighting and security cameras. Soffits and window walls are original to the facility and are out of compliance with current wind load requirements, and at the end of their lifecycle. Additional bracing will be added to the soffit area, and windows will be removed and replaced with wind-rated aluminum louvers, mitigating the potential for future storm damage to the facility.
The Myakkahatchee Creek Water Treatment Plant, located at 5655 North Port Boulevard, North Port, Florida, 34287, sustained damage to a site light pole and fixture, which will require replacement and a new electrical connection. Windows at the Raw Water Buildings, High Service Pump Room, Surface Clear Wells, and Laboratory are original to the facilities and are out of compliance with current wind load requirements and at the end of their lifecycle. Fourteen windows, in total, will be removed and replaced with wind-rated aluminum louvers, mitigating the potential for future storm damage to the facility.
Upon evaluation of the project, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to completing these projects. The CMaR contracting process includes the following two phases:
Ø Phase One: The Contractor is selected and issued a Work Assignment for the Pre-Construction Phase. During this portion of the project, the contractor evaluates the work required, obtains quotes from applicable contractors, and develops the Guaranteed Maximum Price (GMP).
Ø Phase Two: The Fifteenth Amendment to the CMaR Contract No. 2023-17.004 is for the Construction Phase of the process.
The Utilities Department supported the direct selection of Jon F. Swift, Inc. as the preferred CMaR to perform the repair and mitigation services of the Hillsborough Booster Station and Myakkahatchee Creek Water Treatment Plant due to their unique qualifications and extensive experience with this type of work performed. Accordingly, staff requests City Commission approval of the Fifteenth Amendment to CMaR Contract No. 2023-17.004 with Jon F. Swift, Inc., in the amount of $283,885.00

Financial Impact
Funding in the amount of $283,885.00 is allocated in the Fiscal Year 2026 Utilities Budget, project number IAN22, account number 420-6061-533.62-00.
There may be a potential opportunity to seek reimbursement from Federal Emergency Management Agency (FEMA) for these costs, and the City intends to pursue that option. However, this possibility is not a factor in the decision to proceed with the work assignment, and the City will assume full financial responsibility regardless of any reimbursement outcome.
