TITLE: A Resolution of the City Commission of the City of North Port, Florida, Providing for the Approval and Execution of the State-Funded Grant Agreements Between the City of North Port and the State of Florida Department of Transportation Regarding the Reconstruction of Drainage Under Price Boulevard at the Blueridge Waterway, MacCaughey Waterway, Lagoon Waterway, and Creighton Waterway; Providing for Incorporation of Recitals; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.

Background Information
During the City Commission Regular Meeting held on January 10, 2023, the City Commission granted approval of Consent Agenda item number 23-0008, Authorize City Manager to submit the Price Boulevard Waterway and Myakkahatchee Bridge Hardening Improvements Project for consideration in the Fiscal Year 2024 State of Florida Appropriations Request.
Initially proposed at $15 million, the project scope included the reconstruction of drainage under Price Boulevard at the Blueridge Waterway, MacCaughey Waterway, Lagoon Waterway, and Creighton Waterway, and the rehabilitation of the Myakkahatchee Creek Bridge. However, in light of financial constraints at the state level, City staff, in collaboration with the City’s lobbyist and state officials, engaged in negotiations to refine the project scope and reduce costs. Consequently, the revised project scope excluded the Myakkahatchee Creek Bridge project, while retaining the reconstruction of drainage under Price Boulevard at the Blueridge Waterway, MacCaughey Waterway, Lagoon Waterway, and Creighton Waterway. The funding request for Fiscal Year 2024 was reduced and approved for $1.5 million.
Additional funding was requested for this project through the Fiscal Year 2025 State of Florida Appropriations Request cycle. The funding request was vetoed by the Governor and not approved.
This Resolution replaces 2024-R-18, which was approved at the May 28, 2024, Regular Commission meeting. The state’s fiscal year ended on June 30, 2024. Because the grant agreement was not fully executed prior to the end of the state’s fiscal year, it required a new contract with a change on the expiration date. One year has been added to the expiration date in the new contract, extending it to June 30, 2028.
The State-Funded Grant Agreement between the City of North Port and the Florida Department of Transportation regarding the Reconstruction of Drainage Under Price Boulevard at the Blueridge Waterway, MacCaughey Waterway, Lagoon Waterway, and Creighton Waterway has been reviewed by the City Attorney and is legally correct as to form.

Financial Impact
The State-Funded Grant Agreement will reimburse the City up to $1.5 million for the stipulated construction as per the Agreement. The project grant funding revenue and expenses will be budgeted in R15PW1 fund 107.
Procurement
Procurement Code, policies and procedures will be followed when the purchase is made.
