TITLE:                     Ratification of City Manager's Use of Emergency Authorization to Enter Into a Contract With B&E Signal and Lighting, Inc. for Transportation System Repairs Under Purchase Order No. 049527 in an Amount Not to Exceed $900,987.75.

 

 

Recommended Action

 

Ratification of City Manager's use of emergency authorization to enter into a Contract with B&E Signal and Lighting, Inc. for Transportation System Repairs under Purchase Order No. 049527 in an amount not to exceed $900,987.75.

 

Background Information

 

On September 23, 2022, Florida Governor Ron DeSantis issued Executive Order Number 22-218, declaring that a state of emergency for 24 counties, including Sarasota County due to Tropical Depression Number Nine, which became Hurricane Ian.  On September 24, 2022, Governor DeSantis issued Executive Order Number 22-219, amending Executive Order Number 22-218 and expanding the state of emergency to the entire State.  On November 21, 2022, Governor DeSantis issued Executive Order Number 22-268, renewing the state of emergency for an additional sixty (60) days. On March 17, 2023 Governor DeSantis issued Executive Order 23-60, renewing the state of emergency for an additional 60 days. Subsequently, Governor DeSantis Issued Order 23-104 on May 15, 2023, extending the state of emergency for another 60 days.

 

 

On September 26, 2022, the City Commission adopted Ordinance No. 2022-30, declaring a local state of emergency and granting emergency authority to the City Manager.  In his emergency authority, the City Manager entered into the following purchase order and attachments, which constitute a legal Contract.  The City Manager requests that the City Commission ratify this Contract approval.

 

Ø                     Purchase Order No. 049527 and Contract attachments with B&E Signal and Lighting, Inc. for transportation system repairs in the amount $900,987.75. Hurricane Ian damaged the transportation system including traffic signals, traffic cameras, school zone flashing beacons, streetlights and poles deeming the transportation system in emergency/exigency need for repairs.

Financial Impact

 
Funding in the amount not to exceed $900,987.75 was provided from existing appropriations in Fiscal Year 2023 Road and Drainage District budget, account number 107-5000-541.46-08, CIP Project Number IAN22.  Resolution No. 2023-R-06 was approved to restore funding in the amount of $871,787.75 and a budget amendment to fund 107 will follow supporting $29,200.00 to restore funding for urgent needs.

These services were procured in accordance with Sec. 2-408 of the Procurement Code - Emergency Procurement, Local State of Emergency Ordinance No. 2022-30 and Federal Emergency Management Agency (FEMA) Guidelines for Emergency/Exigency Procurements.
