Staff recommends City Commission approve VI1-22-139 and approve Ordinance No. 2023-13 and continue to second reading.

General Information

 

The Forestar Group requests approval of a Village Index Map for 2086+/- acres of land, comprising the Toledo Village development (“Project”). The Project consists of 11 parcels, PID nos. 1092003000, 1092002000, 1089001000, 1090002000, 1090001000, 1095001000, 1088002000, 1088001000, 1097002000, 1097001000, and 1111001000 and is located east of Toledo Blade Boulevard.and approximately one (1) mile north of the I-75 interchange. The subject parcel is zoned Village (V) with a Future Land Use of Village.

 

Background

 

The Village Index Map includes the entire ±2086-acre Village located to the north of I-75 and east of Toledo Blade Boulevard. The purpose of the Village Index Map is to provide an overview of uses, roadways, and pathways for Toledo Village.

 

This project began with Ordinance No. 2001-46 the Glawson/Carlton Comprehensive Plan Amendment, which granted the parcels a Village Future Land Use. In May of 2003, H.M.T.A. purchased the parcels to the east of the Glawson/Carlton area and applied for a second Comprehensive Plan Amendment to reclassify ±571 acres to Village, which was approved with Ordinance No. 04-37.

 

The approval of Ordinance 04-37 was flagged by the Department of Community Affairs (DCA) because it failed to include a density cap. A Stipulated Settlement Agreement between DCA and the City of North Port regarding a remedial amendment was proposed for the H.M.T.A. property. During the City Commission Regular meeting held on April 23, 2007, the City Commission adopted Ordinance No. 07-16 to address the issues with Ordinance No. 04-37.

 

On August 29, 2006, Ordinance No. 06-18 approved the rezoning of ±1,296 acres from Sarasota County designation OUE-1 to City of North Port’s Village.

 

Ordinance No. 2023-13 has been reviewed by the City Attorney and is legally correct as to form.

 

On May 4, 2023, this Petition was presented to the Planning and Zoning Advisory Board. The Planning and Zoning Advisory Board had one comment regarding Future Land Use Element, Policy 13.4.1, which states all housing units are generally within a ½ mile radius of neighborhood centers. Staff has reviewed this and determined the Index Map complies with Policy 13.4.1.

 

During the Planning and Zoning Advisory Board Regular Meeting held on May 4, 2023, the Planning and Zoning Advisory Board voted unanimously recommending approval of Ordinance No. 2023-13 to the City Commission. The original Ordinance No. 2023-13 reviewed by the Planning and Zoning Advisory Board and the revised Ordinance No. 2023-13 based on their comments have been included in the attachments.

 

Information for Second Reading:

 

City Commission heard this Petition at first reading on May 23, 2023, and voted unanimously to approve Petition VI1-22-139 via Ordinance No. 2023-13. Ordinance No. 2023-13 was continued to second reading on June 13, 2023.
