Recommended Action

 

Discussion and possible action to approve or deny the Fourth Amendment to the Lease Agreement By and Between the City of North Port, Florida, and the North Port Senior Center, Inc. for space at the Community Education Center located at 4940 Pan American Boulevard, North Port, Florida.

City Commission Options

 

Option1:  Approve the Fourth Amendment to the Lease Agreement By and Between the City of North Port, Florida, and the North Port Senior Center, Inc. for space at the Community Education Center located at 4940 Pan American Boulevard, North Port, Florida.

 

                     Pros:

o                     Approval of the Fourth Amendment to the Lease Agreement will allow the North Port Senior Center to continue to provide services to the community.

o                     Maintains the long-standing relationship between the City of North Port and the North Port Senior Center.

 

                     Cons:

o                     Providing discounted access to City-owned property through a Lease Agreement with the  North Port Senior Center limits the City’s ability to use the space for staff or programs, or to make it available to another entity to offer alternative services to residents.

 

o                     Two documented violations within the past year raise concerns about compliance and accountability.

 

Option 2:  Deny the Fourth Amendment to the Lease Agreement By and Between the City of North Port, Florida, and the North Port Senior Center, Inc. for space at the Community Education Center located at 4940 Pan American Boulevard, North Port, Florida.

 

                     Pros:

o                     Creates the capacity for reallocation, either within the organization or to another tenant, allowing it to be used for services that meet community needs.

 

                     Cons:

o                     Could lead to the loss of senior services the community relies on. 

 

Background Information

 

The North Port Senior Center, Inc. provides programs and activities to seniors, Monday through Friday at the Community Education Center located at 4940 Pan American Boulevard, North Port, Florida.

 

The following provides a chronological order of events pertinent to the Lease Agreements between the City of North Port, Florida, and the North Port Senior Center, Inc.:

 

Ø                     The lease amount of $200 per month is unchanged from the previous Lease Agreements.

 

Ø                     The First Amendment to the Lease Agreement expired on September 30, 2023.

 

Ø                     A Second Amendment was made extending the terms of the previous Lease Agreement by one year, expiring on September 30, 2024.

 

Ø                     A Third Amendment was made extending the term of the Agreement by one additional year, expiring on September 30, 2025.

 

Ø                     This Fourth Amendment has been made extending the term of the Agreement by one additional year, expiring on September 30, 2026.

 

Ø                     Once a City-wide standardized Lease Policy takes effect, the Lease Agreement will need to come back to Commission for approval under the new terms.

 

The Fourth Amendment to the Lease Agreement By and Between the City of North Port, Florida, and the North Port Senior Center, Inc. for space at the Community Education Center located at 4940 Pan American Boulevard, North Port, Florida, has been reviewed by the Interim City Attorney and is legally correct as to form.
