TITLE:                     Approve Memorandum of Understanding Between the City of North Port and the Southwest Florida Police Benevolent Association, Inc., (PBA).

 

 

Recommended Action

 

Approve Memorandum of Understanding between the City of North Port and the Southwest Florida Police Benevolent Association, Inc., (PBA).

 

Background Information

 

On April 20, 2023, the City’s management team met with PBA representatives for the purpose of negotiating wages for Sergeants and Police Officers in Appendix A of the current Collective Bargaining Agreement.  Due to the rise of wages in regional and competing law enforcement agencies, both sides negotiated a wage that allows the City of North Port to remain competitive within the region and attract talented candidates for the City’s vacancies. Upon tentative agreement of the amended Appendix A with management, PBA representatives met with its membership with an ultimate vote of 71-0 in favor of the wage increases.

 

Highlights of the Memorandum of Understanding are as follows:

 

Ø                     All portions of the current collective bargaining agreement (Term: 10/01/2021 - 9/30/2024) remain the same with the following wage adjustments made to their annual base salary:

 

ü                     All current Police Officers and Sergeants shall receive a salary adjustment (increase) to their annual base salary of $10,214.17 effective beginning of the first pay period following the effective date of this Memorandum of Understanding; and

 

ü                     Effective October 1, 2023, the pay plan for all covered employees shall receive a salary adjustment (increase) of 2.5% as agreed to in the current Collective Bargaining Agreement.  This increase is reflected in the attached hereto as Exhibit “A.”

 

ü                     Per Article 7, Section 1 of the current Collective Bargaining Agreement, the City is exercising its right to implement an 84-hour work schedule for Police Officers and Sergeants which will begin the first pay period following the effective date of this Memorandum of Understanding.   

 

Ø                     This Memorandum of Understanding, and all provisions of the current Collective Bargaining Agreement, including the Professional Development Plan, remain in full force and effect until September 30, 2024, or until a successor Agreement is ratified, whichever occurs first.

 

The attached Memorandum of Understanding between the City of North Port and PBA has been reviewed by the City Attorney and is legally correct as to form.

Financial Impact

 

Ø                     Fiscal Year 2022-2023

 

A total of $528,182 is needed to fund the wage adjustments of the Police Officers and Sergeants annual base salaries described in the Highlights of the Memorandum of Understanding of the Background Information.  The following provides a breakdown of the total cost:

The following funding sources will be utilized for the wage adjustments of the Police Officers and Sergeants annual base salaries:

 

ü                     $30,000 in savings is available in the Fiscal Year 2022-2023 Police Department   Budget, Salaries, account number 001-2100-521-12-00.

 

ü                     $70,000 in savings is available in the Fiscal Year 2022-2023 Police Department   Budget,

Fuel/Gasoline, account number 001-2100-521-52-02.

 

ü                     $428,182 is being requested to be utilized from the City’s General Fund Fund Balance Account.  This is subject to Commission approval of a budget amendment.

An estimated total amount of $1,584,546 will need to be budgeted in the Police Department Regular Salaries account to fund the wage adjustments for the annual base salaries of the Police Officers and Sergeants.
