TITLE:                     A Resolution of the City Commission of the City of North Port, Florida, Granting a Non-Exclusive Permanent and Exclusive Temporary Construction Easements Located on a Portion of the Parcel Lying in Section 12, Township 40 South, Range 20 East, Sarasota County Florida, Property Appraiser Parcel Identification Numbers 0793-00-1010 and 0815-00-1010; Providing Various Easements; Providing for Incorporation of Recitals; Providing for Filing of Documents; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.

•                     Pros: Allows the Peace River Manasota Regional Water Supply Authority (PRMRWSA) Water Main Extension Project to proceed.  The water main extension is a critical infrastructure project for PRMRWSA and Sarasota County.
•                     Cons: Approving the easement will allow PRMRWSA the ability to operate and maintain their infrastructure within the easement area, which will increase access to the land when maintenance and operations are needed on the pipeline.
 
Option 2: Deny Resolution No. 2025-R-84.
 
•                     Pros: Denying the easement will allow the City of North Port to maintain exclusive control over the entire property.
•                     Cons: Denial will delay the PRMRWSA water extension project timelines and could potentially cause a hardship for neighboring water systems, including Sarasota County.
 
Background Information
 
The Regional Integrated Loop System Phase 2B Pipeline is approximately 13-miles of 42” diameter pipe beginning near the western end of the existing Phase 2 Regional Interconnect and 36-inch diameter Charlotte County Regional Transmission Main (CCTM), near the intersection of Harbor Boulevard and Veterans Boulevard in Charlotte County.  As currently envisioned, based on the recently completed Phase 2B/2C Feasibility and Routing Study, the Phase 2B Pipeline will extend generally west and south, crossing the Myakka River terminating at or in the vicinity of the Charlotte County Utilities Gulf Cove Booster Station.  The Phase 2B project includes metering facilities, telemetry, and other appurtenances appropriate to make the Phase 2B Project fully functional for transfer and delivery of finished water and support a future connection with the Regional Integrated Loop Phase 2C Interconnect. 
 
The PRMRWSA requires two (2) utility easements for the construction of the Phase 2B pipeline through the City of North Port’s deep injection well property.  Granting of these easements and installation of the 42” water main will not have any effect on the existing City of North Port Utility infrastructure on the site.  The temporary easement for construction purposes will terminate upon the first occurrence of one of the following actions:
 
Ø                     Two (2) years from the date of the signed Agreement; or 
Ø                     Order by the Court granting PRMRWSA easements rights; or
Ø                     The recording of a Certificate of Completion of the construction by PRMRWSA.
 
Although the City Commission is scheduled to act on this item before the Peace River Authority, staff recommends that any approval be expressly contingent upon the Peace River Authority granting its approval at its December 3, 2025, meeting. 
 
Resolution 2025-R-84 has been reviewed by the City Attorney and is legally correct as to form.
 
Resolution 2025-R-84 was provided to the City Clerk’s Office on October 21, 2025, for signatures, subject to City Commission approval.
