TITLE:                     Approve the Memorandum of Agreement 287(g) Task Force Model Between United States Immigration and Customs Enforcement (ICE) and the City of North Port, Florida, on Behalf of the North Port Police Department, for the Performance of Certain Immigration Enforcement Functions.

 

 

Recommended Action

 

Approve the Memorandum of Agreement between United States Immigration and Customs Enforcement (ICE) and the City of North Port, Florida, on behalf of the North Port Police Department, for the performance of certain immigration enforcement functions.

 

Background Information

 

The purpose of this Memorandum of Agreement (MOA) is to set forth the terms and conditions pursuant to which selected North Port Police Department Officers will be nominated, trained, and thereafter be approved by Immigration and Customs Enforcement (ICE) to perform certain functions of an immigration officer under the direction and supervision of ICE within the City of North Port.

 

It is in the City’s best interest to enter into the MOA. The collaboration with ICE, through the execution of this MOA, will enhance deportation efficiency and contribute to safer communities. Section §908.104, Florida Statutes, requires Florida law enforcement agencies, along with the officials responsible for directing or supervising these agencies, to make their best efforts to support the enforcement of federal immigration laws. Failure by law enforcement agencies or their supervising officials to fulfill their obligations under Chapter 908 may result in consequences as specified in §908.107, Florida Statutes.

 

The Memorandum of Agreement between United States Immigration and Customs Enforcement (ICE) and the City of North Port, Florida, on behalf of the North Port Police Department, for the performance of certain immigration enforcement functions has been reviewed by the Interim City Attorney and is legally correct as to form.
