TITLE:                     Second Amendment to the Cooperative Funding Agreement 17CF0000449 Between the Southwest Florida Water Management District and the City of North Port for Aquifer Storage and Recovery Permanent Facilities.

 

 

Recommended Action

 

Approve the Second Amendment to the Cooperative Funding Agreement 17CF0000449 between the Southwest Florida Water Management District (SWFWMD) and the City of North Port for Aquifer Storage and Recovery (ASR) Permanent Facilities.

 

Background Information

 

The City’s ASR well project began in 1998 with cooperative funding from the SWFWMD.  Since that time, the City has applied for continued cooperative funding each year for the project, providing a project work plan, funding availability, and schedule of tasks and deadlines to be completed each fiscal year.  The information provided in each cooperative funding application forms the basis for each Cooperative Funding Agreement. The design and construction of the Permanent ASR Facilities was submitted to SWFWMD for cooperative funding and resulted in a Cooperative Funding Agreement which was approved by the City Commission on May 10, 2017. 

 

The construction of the Permanent ASR Facilities started November 1, 2017 and was completed September 28, 2018 with Cycle Test 6 beginning in August 2018.  After the completion of Cycle Test 6, the application for an operational permit was submitted to the Florida Department of Environmental Protection (FDEP) on September 30, 2019. Since the application submission, the City has responded to a request for information (RAI) from FDEP and is awaiting the final response from FDEP on whether they will issue the permit or require more testing, data collection, and analysis.

 

SWFWMD finalized the Second Amendment to Cooperative Funding Agreement No. 17CF00000449 between the Southwest Florida Water Management District (SWFWMD) and the City of North Port for “Aquifer Storage and Recovery (ASR) Permanent Facilities” to recognize the increase in time it has taken for the permitting process. The Second Amendment extends the current expiration date of September 30, 2020 to September 30, 2021 to ensure enough time to obtain the operational permit. 

 

Legal has approved the Amendment as to form and correctness.
