SUBJECT:                     Consideration of Petition DMA-24-093 Ekos at Arbor Park II (QUASI-JUDICIAL)

Recommended Action

The Planning & Zoning Advisory Board recommends that the City Commission deny DMA-24-093.

General Information

On June 14, 2024, the Planning & Zoning Division received an application petitioning the City of North Port to approve a Development Master Plan Amendment to develop a second phase of a mixed-use development comprised of three, three-story buildings totaling 66 multifamily units and 7,799 square feet (SF) of commercial space. The subject property is zoned Planned Community Development (PCD) with a Future Land Use designation of Activity Center.

The applicant is proposing residential units for the parcel, even though the parcel was identified as potential future development - non-residential under the previously approved DMP. Because the percentage of land allocated to residential use in AC5 has been exhausted, before scheduling public hearings, staff had multiple meetings with the applicant to discuss increasing the project’s balance of uses to 35% non-residential versus 65% residential of the constructed building square footage.

For these reasons staff requested the applicant increase the proposed 9% non-residential use (commercial) to a higher more sustainable percentage of 35% to receive a staff recommendation of approval for the project.

A legal ad was published in a newspaper of general circulation 15 days prior to the Planning and Zoning Advisory Board meeting date.
