TITLE: Discussion and Possible Action Regarding Expediting the Inclusion of a Property Standards Section in the Unified Land Development Code to Establish an Enforcement Mechanism for the Maintenance of Privately Owned Infrastructure to Include but Not Limited to Roads, Walls, and Stop Signs.
Recommended Action
Discussion and possible action regarding expediting the inclusion of a Property Standards section in the City’s Unified Land Development Code to establish an enforcement mechanism for the maintenance of privately owned infrastructure (roads, walls, stop signs etc.) located behind the businesses.
Background Information
On May 26, 2020, the City Commission discussed the ongoing issues regarding a private road/alley between Sumter and Tuscola, commonly referred to as the road behind Popeyes and CVS. In the past, the City has performed pothole and roadway repairs due to concerns for public safety, well-being of city vehicles such as solid waste trucks and first responder vehicles, and citizen feedback.
In March of this year, Commissioner McDowell was alerted to the deteriorating conditions of the privacy wall along this same road/alley. This wall was required to be installed at the same time the commercial property was developed. Code Enforcement has been alerted and the process has begun to gain compliance. Based on email communication from staff, the privacy wall would fall into the same category as the private roadway - Property Standards.
During the November 1, 2021 ULDC joint meeting, staff advised the Commission of their plans to include a property standards code in the ULDC rewrite. Since the ULDC rewrite has been paused, Commissioner McDowell is requesting a commission discussion to determine if this should be expedited rather than wait for the completion of the ULDC rewrite.
