Recommended Action
Option 1: Approve Res. No. 2026-R- , as presented.
City Commission Options
Option 1: Approve Res. No. 2026-R- , as presented.
• Pros: Approval of Resolution No. 2026-R-XX would provide the City with the immediate ability to address and rectify a situation having adverse consequences for Public Safety and Convenience.
• Cons: The City has no legal responsibility for maintenance of the portion of the alley. Although acceptance of that responsibility is within the City’s discretion, it would have a minimal financial impact that the City is not obligated to incur.
Option 2: Deny Res. No. 2026-R- , as presented.
• Pros: Denial of the Resolution would allow the City to avoid any adverse financial impacts.
• Cons: Denial of the Resolution would allow an unsafe and inconvenient situation to linger with no clear resolution.
Background Information
This portion of the alley has for many years been accessible to, and used regularly by, the public to access the rear of several properties on Tamiami Trail. Over the years it has fallen into a hazardous state of disrepair. The North Port Offices Condominium Association has made a request for City maintenance to alleviate the problem. Although such maintenance is not the City’s responsibility, it is not clear that there is any single party or entity that is responsible. As a result, no maintenance is being carried out, creating a hazardous and inconvenient situation for the public that continues to deteriorate.
Res. No. 2026-R-XX has been reviewed by the City Attorney’s Office and is legally correct as to form.
Res. No. 2026-R-XX has been submitted to the City Clerk’s Office on September 30, 2026, for signature subject to City Commission approval.

Financial Impact
The Public Works Department already provides identical maintenance services for public ways throughout the City. The addition of this small portion of the alley to those responsibilities will have a minimal financial impact on the City.
