Background Information

 

Mark Gerenger, on behalf of Sabal Trace Development Partners, LLC, a Florida limited liability company, as developer of all the property within the boundaries of the proposed Central Parc Community Development District petitions the City of North Port pursuant to the Uniform Community Development District Act of 1980, Chapter 190, Florida Statutes, as amended to adopt an ordinance to establish a Uniform Community Development District (CDD).  As established by the Florida Legislature, a CDD is a local unit of special-purpose government which is limited to the performance of those specialized functions authorized by the State.  Those specialized functions consist of planning, financing, constructing, and maintaining certain public infrastructure improvements and community development services.  As an independent special district, the CDD’s governing body establishes its own budget and, within the scope of its authorized powers, operates independent of the local general-purpose government.  However, a CDD must abide by all planning, environmental, and land development laws, regulations, and ordinances adopted by the local general-purpose government.  The site contains ±207.5 acres and is located north of Greenwood Avenue, east of North Port Boulevard, south of Appomattox Drive, and west of Sumter Boulevard.

 

Staff has reviewed this request to establish a CDD and finds that it is consistent with and meets the statutory requirements contained in Florida Statutes, Chapter 190, pursuant to the establishment of districts less than 2,500 acres of land.  Pursuant to these regulations, the District is adopted by ordinance.  Other established City districts include the Bobcat Trail CDD, the Lakeside Plantation CDD, and the Woodlands CDD. 

 

Ordinance 2020-04 has been reviewed and approved by the City Attorney as to form and correctness.  It has been advertised in a newspaper of general circulation pursuant to applicable local and state regulations.

A few proofreading items have been corrected, so an updated Ordinance No. 2020-04 has been attached for second reading.  No content changes have been made.
