Recommended Action

 

Approve the Fifth Amendment to Agreement No. 2019-48.001 Debris Management Services and Ancillary Preparation/Recovery Services between the City of North Port, Florida, and Ceres Environmental Services, Inc.

 

Background Information

 

On April 22, 2024, Office of Management and Budget (OMB) revised sections of OMB Guidance for Grants and Agreements found in Title 2 of the Code of Federal Regulations. These revisions apply to all of the Federal Emergency Management Agency (FEMA) awards with a federal award date or disaster declaration date on or after October 1, 2024, unless specified otherwise. The changes include updates to the federal procurement standards, which govern how FEMA award recipients and subrecipients must conduct purchasing under a FEMA award. Recipients and subrecipients must follow the federal procurement standards outlined in 2 C.F.R. §§ 200.317 - 200.327.

 

FEMA has implemented new provisions effective in 2024 that apply to all Agreements containing federal grants. Both parties (Ceres Environmental Services, Inc., and the City of North Port) mutually desired to amend the original Contracts to incorporate the new FEMA provisions. The Fifth Amendment to Agreement No. 2019-48.001 is a result of incorporating these new FEMA provisions.

Financial Impact

 

For the hurricane recovery work to be considered for reimbursement under the FEMA’s Public Assistance Program, federal contract provisions have been added to the emergency procurement documentation. There is no financial impact to the City unless a disaster occurs. In the event a disaster takes place, funds will be transferred to account number 107-5000-541.34-00, Other Contractual Services.

 

Procurement

 

The original Agreement No. 2019-48.001 was procured through a Sealed Request for Proposal process in accordance with City of North Port Procurement Code Sec. 2-405. The subsequent amendment to the contract was procured following FEMA Guidelines for Emergency/Exigency Procurements and City of North Port Procurement Code Sec. 2-408 (Emergency Procurement).
