Recommended Action
Approve Resolution No. 2018-R-29, authorizing and directing the acquisition by any legal means of certain parcels that are required for stormwater retention ponds as part of the Price Boulevard Widening Project from Sumter Boulevard to Toledo Blade Boulevard.
Background Information
On June 27, 2017, the City of North Port mailed offer letters to the owners of the identified sixteen parcels which are necessary for the construction of the stormwater ponds to accommodate the Price Boulevard Widening Project between Sumter Boulevard and Toledo Blade Boulevard. The offer letters reflected the just value of the properties contained in an Appraisal Report completed on March 1, 2017, for each parcel.
The City has been able to acquire six of the sixteen parcels needed for the stormwater retention ponds. On one of the original identified parcels, containing two lots, a developer constructed a model home and a parking area. The Consulting Engineer for the design for the Price Boulevard Widening Project identified two substitute parcels for the one developed with the model home and parking area. There are now a total of seventeen parcels. The City sent offer letters to these two parcels on February 14, 2018, and February 15, 2018. To date, there has been no response or counter offer from the property owners of those two parcels.
During the Road and Drainage District Governing Body Commission Meeting held on May 22, 2018, subsequent to review and discussion of the typical roadway cross section for the Price Boulevard Widening Project from Sumter Boulevard to Toledo Blade Boulevard, the Commission approved Option 1, changing the gutter to a Type F; the 7-foot utility strip B to 2-feet; keeping the 10-foot multi-use trail; and the 3-foot utility strip A to 8-feet. On May 24, 2018, staff instructed the Consulting Engineer for the Price Boulevard Widening Project to proceed with the design of the typical section in accordance with the Commission’s approval.
The Consulting Engineer submitted 60% plans for review on December 14, 2018. The next phase in the Price Boulevard Widening Project will include the permit application to the Southwest Florida Water Management District (SWFWMD) for the stormwater drainage improvements including the facilities and stormwater pond sites required for the Price Boulevard Widening Project. The SWFWMD Permit is based on the stormwater pond site locations presented in the permit application and drainage report. Any changes to the stormwater pond site locations will require a re-design of the stormwater system by the Consulting Engineer and a Permit Modification application to SWFWMD. Any changes or modifications can greatly affect the schedule and cost of the Price Boulevard Widening Project.
The City Attorney has approved Resolution No. 2018-R-29 as to proper form.
