General Information

Section 163.3177(6)(c), Florida Statutes, requires local governments to adopt and update a 10-year Water Supply Facilities Plan into their Comprehensive Plan within 18 months after the Southwest Florida Water Management District adopts the Regional Water Supply Plan.  In November 2020, the Southwest Florida Water Management District (SWFWMD) approved the Regional Water Supply Plan.  On May 17, 2022, the City of North Port Utilities Department, in coordination with Black & Veatch, completed the Water Supply Facilities 10-Year Work Plan Update.  On May 17, 2022, Black & Veatch submitted the plan to the SWFWMD, who acknowledged receipt on May 18, 2022.

The City of North Port Water Supply Facilities 10-year Work Plan Update is to the proposed Ordinance 2023-27 as Exhibit A.  In review of the plan, the following should be noted:

1.This plan was completed prior to the amendment to the Conservation and Coastal Zone Management Element, which created a separate Conservation Element and Coastal Management Element. 

2. Page 2-10, Table 3, Footnote 1, and top of Page 2-11.  The Sable Trace referred to residential bulk customer, not the golf course.  Central Parc will be a new customer when they connect. 

3. Page 3-1, Page 3-2, Table 4 relates to Potable Water Demand Projections; thus, the population projections go to the population of customers served, not to be confused with overall population projections for the City.

4. Page 3-3 projected completion of the Southwest Water Treatment Plant in the summer of 2022, which plant was completed in 2023.

The petition was advertised in a newspaper of general circulation within the City of North Port on August 22, 2023, pursuant to the provisions of Section 166 and 163, Florida Statutes and Section 7.01(c) of the Charter of the City of North Port.

The Planning & Zoning Advisory Board will hear this item at their September 7, 2023 meeting.  The PZAB recommendation will be transmitted to the City Commission as soon as available, and staff will state the recommendation at the City Commission meeting. 

Within ten (10) days after the first reading, this ordinance and the appropriate supporting data and analyses shall be transmitted to the Florida Department of Economic Opportunity, Southwest Florida Regional Planning Council, Southwest Florida Water Management District, Florida Department of Environmental Protection, Florida Department of State, Florida Department of Transportation, Sarasota County, Florida, and any other local government or governmental agency who has filed a request with the City. These agencies shall review and provide comments pursuant to Florida Statutes Section 163.3184 before the ordinance goes to second reading.

Within ten (10) days of final adoption of this ordinance, this ordinance and all documents shall be transmitted to the Florida Department of Economic Opportunity and any other agency or local government that provided timely comments pursuant to Florida Statutes Section 163.3184.

Information for Second Reading:

On September 17, 2023, the proposed comprehensive plan amendment was transmitted to Florida Commerce, Bureau of Community Planning and Growth.  On October 17, 2023, Florida Commerce provided a letter indicated they had no comments.  City staff received comments from Southwest Florida Water Management District (SWFWMD) on October 11, 2023. The comments were addressed by staff on December 1, 2023. On December 4, 2023, SWFWMD indicated they had no additional comments.

Pursuant to Florida Statutes Section 166.041(4)(c), a business impact estimate was not required because this ordinance is enacted to implement Part II of Florida Statutes Chapter 163, relating to growth policy, county and municipal planning, and land development regulation, including zoning, development orders, development agreements, and development permits.
