TITLE:                     Ordinance No. 2018-32, Second Reading, Petition No. TXT-18-147, Amending the City of North Port Unified Land Development Code Chapter 60 Fire Safety Regulations, Section 60-19 Conflicts to remove language in direct conflict with the Florida State Statutes and Florida Administrative Code.  

 

 

Recommended Action

 

The City Commission approve Ordinance No. 2018-32, Petition No. TXT-18-147.

 

Background Information

 

The petition was advertised in a newspaper of general circulation within the City of North Port on July 3, 2018, pursuant to the provisions of Section 166.041(3)(a), Florida Statutes and Section 9.01(b) of the Charter of the City of North Port, and Chapter 1, Article II, Section 1-12 of the City’s Unified Land Development Code (ULDC) as amended.

 

The City of North Port Fire Rescue District submitted Chapter 60 of the Unified Land Development Code (ULDC) to the State of Florida Fire Marshal Office for publication of the City of North Port Adopted Local Amendments to the Florida Fire Prevention Code using Method II: §633.0215(10) sub. para (c). Upon review it was noted that the following section is in direct conflict with State Statute and the Florida Administrative Code. It was recommended that the following words in quotations be removed from the section and the underlined be added to the section.

 

Sec. 60-19. Conflicts. In the event of conflict between this code "and the Florida Administrative Code, State Statutes" or the Florida Fire Prevention Code, the “most” more stringent code shall apply.
