Recommended Action
Approve Resolution No. 2016-R-28, Petition No. VAC-16-153 partial vacation of the platted rear (10) ten-foot utility and drainage easements.
Background Information
Mr. R.J. Doerrfeld, on behalf of the property owners Larry and Barbara Ann Moore is requesting a partial vacation of the platted rear ten (10) foot utility and drainage easements located on lots 16, 17, 31 & 32 for the construction of a single-family home and septic system. The site contains ± 469 square feet and is located south of and adjacent to Lapidus Road and north of and adjacent to Hornbuckle Boulevard.
Pursuant to Chapter 177.101 of Florida Statutes, an application has been made to the City of North Port by Mr. R.J. Doerrfeld, on behalf of the property owners Larry and Barbara Ann Moore to formally request a partial vacation of the platted rear ten (10) foot utility and drainage easements located on lots 16, 17, 31 & 32, Block 1235, Twenty-Seventh Addition to the Port Charlotte Subdivision, Section 08, Township 39 South and Range 21East.
A legal notice of intent to vacate was published by the applicant in a newspaper of general circulation, for (2) two weeks consecutively.
The Unified Land Development Chapter 53-267 D. provides for vacation of platted easements in accordance with F.S. Chapter 177.
Neighborhood Development Services Planning Division did duly notify the public utilities concerned and has received written approval from these agencies consenting to the partial vacation of the platted rear (10) ten-foot rear utility and drainage easements.
The Planning and Zoning Advisory Board (PZAB) at their regularly scheduled meeting of November 17, 2016, recommended that the City Commission approve Resolution No. 2016-R-28, Petition No. VAC-16-153, the request of R.J. Doerrfeld, on behalf of Larry and Barbara Ann Moore to vacation portions of the platted rear ten (10) foot utility and drainage easements located on lots 16, 17, 31 &32, Block 1235, Twenty-Seventh Addition to the Port Charlotte Subdivision for the construction of a single-family home and septic system with a unanimous 4-0 vote. There were no issued raised.
Staff has no objection to the request for the partial vacation of platted rear ten (10) foot utility and drainage easements located on lots 16, 17, 31 & 32, Block 1235, Twenty-Seventh Addition to the Port Charlotte Subdivision and based on staff’s evaluation and stated findings, staff is recommending approval.
