Recommended Action

 

The Planning and Zoning Advisory Board recommends to the City Commission approval of Petition No. VAC-23-020 via Resolution 2023-R-31.

 

General Information

 

Property owner, Thaddeus J Szumilas, has formally submitted to the City of North Port a written petition to request a partial vacation of the platted rear 20-foot maintenance easement located on Lot 8, Block 160, 5th Addition to Port Charlotte Subdivision. The purpose of the vacation request is to allow a proposed prefabricated shed to encroach into the 20-foot rear maintenance easement.

The subject property is developed and located at 2432 Pretzel Lane and encompasses approximately 0.230 acres.

Pursuant to Florida Statutes Chapter 177.101, an application has been made to the City of North Port to formally request a vacation of a portion of the platted rear 20-foot maintenance easement located on Lot 8, Block 160, Fifth Addition to Port Charlotte Subdivision.

A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation for two (2) weeks consecutively.

The affected utility agencies have been notified of the vacation request and, through written responses, have granted their approval.

The City Attorney has reviewed and approved Resolution 2023-R-31 as to form and correctness.

On April 6, 2023, the petition went before the Planning and Zoning Advisory Board, which voted (7-0) for approval conditioned the petition could prove public legal advertisement was published for one day a week for two consecutive weeks prior to C.C. meeting.
