Recommended Action

 

Approval of the application of Personnel Policy Manual Section 2.17 for Emergency Pay for Charter Officers, Heather Faust, MMC, City Clerk and Amber L. Slayton, B.C.S., City Attorney.

 

Background Information

 

The purpose of this agenda item is to address the application of the City’s personnel policy, 2.17, “Emergency Work Assignments” to Charter Officers, City Attorney Amber Slayton and City Clerk Heather Faust, exempt employees, who worked hours more than 40 hours during the declared emergency for Hurricane Ian. Section 2.17.A.2 of the City ‘s Personnel Policy (“Emergency Pay Policy”) addresses emergency pay for exempt employees, providing that “[an] exempt full-time employee who works during a declared emergency will be compensated at straight time for all hours worked in excess of 40 hours per week.” 

 

Language in the employment contracts for the three City Charter Officers do not address emergency pay.

However, City Manager Jerome Fletcher has the following contract language:

 

Article IV:

 

A. Base Salary.  Employee will be paid an annual base salary of $185,000.00, payable in the same manner as other full-time regular City employees and pursuant to Employer’s regular payroll schedule.

 

K.  Other Benefits. Except as otherwise provided in this Agreement, Employee is entitled at a

minimum, to the highest level of other benefits enjoyed by or offered to Employer’s general employees as provided in the City’s Personnel Policy Manual.  In the event of any conflict between this Agreement and the City’s Personnel Policy Manual, this Agreement will prevail.

 

To be equitable, the recommendation is to pay City Clerk Faust and City Attorney Slayton for hours worked beyond their regular 40-hour schedules in the same manner in which City Manager Fletcher was paid per policy 2.17, “Emergency Work Assignments”.

 

The total amount for both Charter Officers is $ 12,062.34.
