Option 2: Deny the Eighteenth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Phase II by and between the City of North Port and Halfacre Construction Company for construction of the Boca Chica Park in the amount of $821,336.20.
• Pros: Preserves Park Impact Fee funds for potential use on other Park initiatives.
• Cons: Leaves this portion of the City without a nearby park; halts progress on a project that has already received significant investment and aligns with community needs and long-term planning goals.
Background Information
Capital Improvement Project No. P23PAS Boca Chica Park is for the development of a new low-impact, passive park on a 4.19-acre parcel between Ponds Street and Oceanside Street. This area of the City currently lacks adequate park facilities to support the recreation and wellness needs of residents. The park is designed to preserve the natural character of the site while offering accessible amenities that promote physical activity. Key features include minimal parking to reduce the environmental footprint, a natural themed playground area, and a pervious pavement walking path with seating areas nestled within the existing vegetation. Additionally, the project prioritizes the preservation of native trees and plant life throughout the site and has been strategically designed to protect gopher tortoise burrows and maintain safe buffer zones around them. The overall goal is to create a serene, nature-focused space that offer opportunities for play, fitness and education while serving as a valuable resource for the surrounding neighborhoods.
Upon evaluation of the project, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The CMaR contracting process includes the following two phases:
Ø Phase One: The Contractor is selected and issued a Work Assignment for the Pre-Construction Phase. During this portion of the project, the contractor evaluates the scope of work, obtains quotes from subcontractors, and develops the Guaranteed Maximum Price (GMP).
Ø Phase Two: The Construction Phase follows the Pre-Construction Phase. During this phase, the contractor proceeds with the actual construction work based on the agreed GMP. The Eighteenth Amendment to the CMaR Contract No. 2023-17.002 represents the authorization and funding for the second phase of the project.
The Parks & Recreation Department, along with the City’s Project Manager provided a direct selection of Halfacre Construction Company, as the preferred CMaR to perform the construction services at Boca Chica Park. Accordingly, staff requests City Commission approval of the Eighteenth Amendment to CMAR Contract No. 2023-17.002 with Halfacre Construction Company, in the amount of $821,336.20 to begin the second step of the CMaR process.
The Eighteenth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Phase II by and between the City of North Port and Halfacre Construction Company for construction of the Boca Chica Park has been reviewed by the Interim City Attorney and is legally correct as to form.
The Eighteenth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Phase II by and between the City of North Port and Halfacre Construction Company for construction of the Boca Chica Park was submitted to the City Clerk’s Office on September 22, 2025, for signature subject to City Commission approval.

Financial Impact
Funding in the amount of $41,916 is available in the Fiscal Year 2025 budget in Project No. P23PAS, account number 152-3036-572.63-00, and as part of Fiscal Year 2026 appropriated budget an additional $1,000,000 is allocated in account number 152-3036-572.63-00 for available funding of $1,041,916.
