Background Information

 

On November 10, 2022, and on December 6, 2022, City Commission Workshops were conducted regarding Extraordinary Circumstances as required by the State of Florida to increase impact fees.  On June 21, 2022, the City Commission approved Ordinance 2022-03, to increase the City of North Port’s Impact Fee rates based on the 2022 Willdan Impact Fee Study recommendations.  However, the Willdan Impact Fee Study did not include any increases to the Transportation Impact Fees. Currently, Transportation Impact Fee rates are set at 75% of the 2011 Impact Fee Study.  The City is in the process of implementing a Mobility Impact Fee.  Based on the July 25, 2022, City Manager Report and the August 1, 2022, City Manager memorandum, the Mobility Impact Fee implementation has been placed on an “undetermined hold” to provide tine for the completion of the following tasks:

 

Ø                     Planning and Zoning Division staff time to conduct a secondary review of the Mobility and Connectivity Fee Study with the Consultant.

 

Ø                     Legal review of pertinent documents by the City Attorney’s Office.

 

Ø                     Review and approval of the required Comprehensive Plan amendments related to Mobility Impact Fees.

 

These activities have substantially delayed the adoption and implementation of the new Mobility Impact Fees. 

 

A City Commission discussion is necessary to give the City Manager direction to increase the Transportation Impact Fees from 75% to 100% of the 2011 Impact Fee Study, until the final adoption of the Mobility Impact Fee ordinance can take place.

 

This agenda item has been requested by Commissioner Debbie McDowell.
