Background Information
Tony Squitieri, on behalf of Forestar and H.M.T.A. Real Estate LLC, has formally submitted a Rezone application to the City of North Port to Rezone ± 789-acre site zoned No Zoning Designation (“NZD”) to Village (“V”). The applicant is petitioning the City to change the property's zoning to provide for a unified Toledo Village zoning designation for all of the project parcels.
Pursuant to Florida Statutes Chapter 166.043(3)(a)), the procedures for the adoption of ordinances and resolutions have been met. Staff concludes that the petition for rezoning is consistent with the requirements regarding ordinances that change the zoning map designation of a parcel of land.
A legal notice of intent to rezone was published by the City of North Port in a newspaper of general circulation, August 2, 2022.
The City Attorney has reviewed the accompanying Ordinance 2022-21 as to form and correctness.
The Planning and Zoning Advisory Board heard this item at their regularly scheduled meeting on August 18, 2022. The Board voted 3-0 to recommend City Commission approval of Ordinance 2022-21, and find that, based on the competent substantial evidence, the rezoning will not adversely affect the public interest, health, safety and general welfare, and that the specific requirements in the City of North Port Comprehensive Plan, and the standards listed in Section 1-33.E(1) of the Unified Land Development Code (ULDC) have been met.
Information for Second Reading
At first reading, City Commission continued Ordinance 2022-21 until the State review for Ordinance 2022-22 was returned. Upon return, both Ordinances were placed on the first available City Commission agenda for second reading.
