Background Information
Passed into law in October 2018, the America’s Water Infrastructure Act (AWIA) amended the Water Resources Development Act and the Safe Drinking Water Act. Section 2013 of the AWIA mandates that water systems serving a population of 3,300 or more must conduct a Risk and Resilience Assessment (RRA), prepare an Emergency Response Plan (ERP) based on the RRA and certify both to the Environmental Protection Agency (EPA). The RRA replaces the previous requirement to perform Security and Vulnerability Assessments and broadened the focus from “terrorism and intentional attack” to “malevolent acts and natural hazards”. The ERP will include strategies and resources to improve resilience including physical security and cyber security. Utilities must certify to EPA that they have completed the RRA by December 31, 2020 and the ERP by June 30, 2021.
On October 17, 2019, Utilities distributed a Request for Letters of Interest (RLI) to all engineers of record under Continuing Contract No. 2016-23 to secure professional engineering services to conduct the required RRA, prepare an ERP based on the RRA and assist Utilities in certifying both to the EPA. Four Letters of Interest were received by the November 22, 2019 due date. Staff evaluated the Letters of Interest based on understanding of project, expertise and qualifications of personnel, timeline and availability, past experience on Department projects, proposed cost savings measures, quality of proposal and references. Based on these established criteria, TKW Consulting Engineers was selected to proceed with the development of a scope and fee schedule and submit it to Utilities by December 17, 2019. Based on careful review of the scope and fee schedule submitted, Utilities is recommending Consor Engineers, LLC, formerly TKW Consulting Engineers, be awarded the work assignment for this project.
On September 14, 2016, Commission approved Continuing Contract No. 2016-23 with TKW Consulting Engineers for a three-year term with a renewal option for up to two additional one-year terms. Commission also authorized the City Manager to approve future renewals. On September 24, 2019, the first renewal was approved by the City Manager. On December 31, 2019, TKW Consulting Engineers, LLC merged with, and will now be operating as, Consor Engineers, LLC. The Assignment of Continuing Contract No. 2016-23 by TWK Consulting Engineers, LLC to Consor Engineers, LLC was submitted to the City on January 13, 2020. Legal reviewed, revised and approved the Contract Assignment as to form and correctness. Continuing Contract No. 2016-23 requires all work assignments $100,000 and over to be presented to Commission for approval.
