TITLE:                     Approve the Licensed Training Provider Agreement and Centennial Addendum By and Between the American National Red Cross and the City of North Port, Florida, for a Thirty-Six Month Term at Contract Unit Prices.

 

 

Recommended Action

 

Option 1:  Approve the Licensed Training Provider Agreement and Centennial Addendum By and Between the American National Red Cross and the City of North Port, Florida, for a thirty-six month term at contract unit prices.

 

City Commission Options

 

Option 1:  Approve the Licensed Training Provider Agreement and Centennial Addendum By and Between the American National Red Cross and the City of North Port, Florida, for a thirty-six month term at contract unit prices.

 

                     Pros:

o                     Maintains compliance with the Florida Department of Health rule 64E-9, allowing operations to continue at the North Port Aquatic Center.

o                     Facilitates reimbursement of up to $24,000 through the American National Red Cross’s Centennial Campaign.

o                     Aligns with national best practices for aquatic safety and training standards.

o                     Strengthens the City’s reputation as a provider of safe, high-quality aquatic programs.

                     Cons: Commits the City to a defined three-year Agreement, which may limit opportunities to evaluate other nationally recognized training programs during that period.

 

Option 2:  Deny the Licensed Training Provider Agreement and Centennial Addendum By and Between the American National Red Cross and the City of North Port, Florida, for a thirty-six month term at contract unit prices.

 

                     Pros: Allows the City to explore other nationally recognized aquatic training programs.

                     Cons:

o                     The City of North Port will not be in compliance with the Florida Department of Health rule 64E-9, halting operations at the North Port Aquatic Center.

o                     Loss of reimbursement opportunity of up to $24,000 through the Centennial Campaign.

 

Background Information

 

The American National Red Cross provides certified curriculum developed by experts in compliance with national drowning prevention and first aid standards.  The North Port Aquatic Center is required to have an executed Agreement and pay an annual fee for compliance with the Florida Department of Health rule 64E-9 which states: “Any individual or organization that wishes to provide a Lifeguard or Swimming Instructor training and certification course in the State of Florida must use a ‘Nationally Recognized Aquatic Training Program’ or equivalent as defined in 64E-9.008(2)(a)2 of the Florida Administrative Code.”

 

The following provides a chronological order of events regarding the Licensed Training Provider Agreement:

 

Ø                     November 26, 2019:  During the City Commission Regular Meeting, the Commission approved the Licensed Training Provider Agreement with the American National Red Cross for a Thirty-Six Month Term.

 

Ø                     February 28, 2023:  During the City Commission Regular Meeting, the Commission approved the Licensed Training Provider Agreement with the American National Red Cross for the Provision of Public Education and Staff Training Services for a Thirty-Six Month Term at Contracted Unit Prices.

 

The Parks & Recreation Department currently seeks to recertify the North Port Aquatic Center and its staff to provide public education and training in First Aid, CPR, Babysitting, Lifeguarding and Water Safety via the terms outlined in the attached Licensed Training Provider Agreement.  Upon approval, the Agreement will be in effect for thirty-six months from date of execution, unless terminated by either party within thirty days’ notice.

 

The Centennial Addendum outlines the City’s participation in the Red Cross’s Centennial Campaign, which promotes water safety in high-risk communities by:

 

Ø                     Expanding Learn-to Swim and Junior Lifeguarding programs.

Ø                     Offering water safety and CPR/AED training to families.

Ø                     Engaging in promotional efforts and voluntary evaluation projects.

Ø                     Reporting program outcomes and submitting documentation for reimbursed expenses.

 

The Licensed Training Provider Agreement and Centennial Addendum By and Between the American National Red Cross and the City of North Port, Florida, for a thirty-six month term at contract unit prices has been reviewed by the City Attorney and is legally correct as to form.

 

The Licensed Training Provider Agreement and Centennial Addendum By and Between the American National Red Cross and the City of North Port, Florida, for a thirty-six month term at contract unit prices was submitted to the City Clerk’s Office on January 16, 2026, for signature subject to City Commission approval.

Appendix B is a products package and price list, that outlines the products and fees associated with the offerings of the North Port Aquatic Center.  The facility fee is $650 which includes Learn to Swim fees.  Training and certification classes require additional fees that vary based on number of courses offered and participants enrolled.

 

External classes will be offered to the public at a participation fee that will offset the incurred Red Cross fee certification per the Licensed Training Provider Agreement.

 

The estimated expenses associated with staff training and certifications through this Agreement are $7,000.00.  Training expenses are budgeted within account numbers 001-3036-572.55-00, 001-3037-572.55-00.  Estimated revenue from Learn to Swim courses taught by Lifeguards with the Red Cross curriculum is projected to be $37,875 annually.  The Centennial Addendum allows the City to submit documentation for reimbursement of up to $24,000.

 

Procurement

 

This service was procured under the City of North Port Procurement Code Section 2-403 (a) (3) b - Exemptions - Subscriptions for periodicals, books, maps or training videos.
