Recommended Action

 

Approve the Agency User Agreement Between Prescription Drug Monitoring Program and City of North Port, Florida, allowing the Police Department to responsibly track and prevent prescription drug abuse.

 

Background Information

 

The Prescription Drug Monitoring Program (PDMP) collects and maintains information in a database pursuant to sections 893.055 and 893.0551, Florida Statutes. The information collected is confidential and exempt from public record disclosure and may only be released under specified circumstances.

 

The Agency User Agreement is a formal contract between the City of North Port and the Florida Department of Health. It outlines the terms and conditions for accessing and using the PDMP data and would allow the North Port Police Department to monitor prescription drug distribution. Its terms include the following:

 

                     Authorized Access: Only specified personnel are allowed to access PDMP Agreement data to ensure privacy and confidentiality.

 

                     Data Usage: The PDMP Agreement data is strictly for monitoring purposes and cannot be misused or shared outside authorized parties.

 

                     Compliance and Security: North Port Police Department (NPPD) must comply with all security measures to protect data integrity and prevent unauthorized access.

 

                     Accountability: NPPD must maintain accurate records of all data access and use for accountability.

 

Participation in the PDMP ensures the City’s commitment to ethical use of prescription data for public safety purposes. The Agency User Agreement has been reviewed by the City Attorney and is legally correct as to form.
