Recommended Action

 

Approve First Amendment to Construction Manager at Risk Contract No. 2023-17.001 for Construction Services Contract Phase II With Wharton Smith in the amount of $1,980,968, for Park Maintenance Temporary Office/Workshop space at Dallas White Park.

 

Background Information

 

The following provides a chronological order of events regarding Park Maintenance Temporary Office/Workshop space at Dallas White Park:

 

Ø                     September 28, 2022: Hurricane Ian made landfall west of Fort Myers, Florida.  Due to impact of Hurricane Ian on the City of North Port, the approximately 7,500 square foot Park Maintenance Building and ancillary storage areas located on Pan American Boulevard were deemed unusable. Since the hurricane, the Parks Maintenance Division field staff have been working remotely from City vehicles and on the exterior space at the Pan American Boulevard Public Services complex.  In addition, supervisory staff have been utilizing space at the George Mullen Activity Center. Dallas White Park has been identified as both a short-term temporary operational site and long-term permanent building site to include an office building, shop space, and secure storage for materials, equipment, and vehicles.

 

Ø                     June 13, 2023: During the City Commission Regular Meeting, the Commission approved the following motions pertinent to Resolution No. 2023-R-42, Amending the Non-District Budget and Capital Improvement Budget for Fiscal Year 2022-2023 for Utilities Costs Due to Hurricane Ian, an Autocar for Solid Waste, Four Full-Time Equivalents (FTEs) and Associated Costs for the New Natural Resources Division, Temporary Space for the Parks Maintenance Division, Land and Design for a Police Headquarters and Construction, Engineering and Inspection (CEI) Services for Price Widening Phase 1 in the Amount of $5,347,140:

 

ü                     Motion:  A motion was made to adopt Resolution No. 2023-R-42 as presented.

 

ü                     Motion: A motion was made to amend the motion to include an additional $600,000 from the general fund for the parks and maintenance facility to be located at Dallas White Park, bringing the budget amendment total to $5,947,140.

 

Ø                     March 5, 2024: During the City Commission Regular Meeting, the Commission approved the following motions pertinent to Resolution No. 2024-R-10, a Resolution of the City Commission of the City of North Port, Florida, Amending the Non-District Budget and Capital Improvement Budget for Fiscal Year 2023-2024 for an Additional 0.5 Full Time Equivalent for Warm Mineral Springs, Road Rehabilitation Project and Parks Maintenance Building in the Amount of $4,502,551:

 

ü                     Motion:  A motion was made to adopt Resolution No. 2024-R-10 as presented.

 

ü                     Motion: A motion was made to amend the motion to include “for Project 922DPB

Legacy Trail Surtax Fund source decrease to $175,000 and Project P22DPB Legacy Trail parking funding use of Impact fee decrease use to $175,000 and use the difference of $8,580 for P23DWM from Park Impact Fee fund balance use.”

 

Resolution No. 2024-R-10 reallocates the adopted Parks & Recreation Department project funds to offset the initial funding phase construction shortfall. This project funding realignment allows for the Parks and Recreation Department to move forward with the Guaranteed Maximum Price (GMP) proposal provided by Wharton-Smith, Inc. This is included in Amendment 1 to Contract No. 2023-17.001 for the initial demolition, temporary construction, and infrastructure improvements at a maximum price of $1,980,968. This proposal includes both infrastructure improvements and an enclosed secure workspace that will support the long-term operations of the Park Maintenance Division.

 

Ø                     2023-2024: In consultation with City Administration and the Purchasing Division of the Finance Department, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The following describes the CMaR process for this project:

 

ü                     The Contractor is selected and issued a Work Assignment for the pre-construction phase. The Contractor evaluates the work required, obtains quotes from applicable contractors, and develops the Guaranteed Maximum Price (GMP).

 

ü                     The Amendment to the Contract presented for approval is for the construction phase of the process. The Project Manager with the Department of Public Works provided a direct selection of Wharton Smith as the preferred CMaR to carry out the project of the Park Maintenance relocation to Dallas White Park and requests approval of this Amendment to proceed to construction. 

 

The First Amendment to Construction Manager at Risk Contract No. 2023-17.001 for Construction Services Contract Phase II with Wharton Smith for Park Maintenance Temporary Office / Workshop space at Dallas White Park has been reviewed by the City Attorney and is legally correct as to form.

Funding in the amount of $1,980,968 has been allocated in the Parks & Recreation Department Fiscal Year 2024 budget in Project No. P23DWM, account numbers 001-3038-572-62-00 ($600,000), 001-3038-572-46-04 ($25,388), 306-3038-572-63-00 ($1,097,000), and 152-3038-572-63-00 ($258,580).

 

Procurement

 

Phase 2 - Park Maintenance Relocation to Dallas White Park Construction Manager at Risk Contract No. 2023-17.001 was procured pursuant Chapter 2 Administration, Article VIII Procurement, Section 2-406 Professional services selection under Consultants’ Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.
