Background Information
On September 14, 2020 the City of North Port Planning Division received a request to designate the ‘Sabal Trace Redevelopment Area,’ consisting of approximately 207.5 acres north of Greenwood Ave., south of Appomattox Dr., west of Sumter Blvd, and east of North Port Blvd., as a brownfield pursuant to the Florida Brownfields Redevelopment Act, F.S. 376.80. This request has been coordinated through the Florida Department of Environmental Protection (FDEP) for the purpose of arsenic remediation on the site.
The designation of a brownfield must be adopted by resolution by the jurisdictional local government and adopted in accordance with the procedures set out in 166.041(3)(c)2, F.S. for adoption of ordinances. For this reason, Resolution No. 2020-R-38 must be heard before the City Commission at two separate meetings. Sec. 376.80(2)(c) states that the government with jurisdiction shall provide notice and adopt a resolution to designate the brownfield area if the following criteria are met:
1. A person who owns or controls a potential brownfield site is requesting the designation and has agreed to rehabilitate and redevelop the brownfield site.
City staff received an application for brownfield designation on September 14, 2020, in which the applicant has committed to rehabilitate and redevelop the site. (Attachment 2)
2. The rehabilitation and redevelopment of the proposed brownfield site will result in economic productivity of the area, along with the creation of at least 5 new permanent jobs at the brownfield site that are full-time equivalent positions not associated with the implementation of the brownfield site rehabilitation agreement and that are not associated with the redevelopment project demolition or construction activities pursuant to the redevelopment of the proposed brownfield site or area. However, the job creation requirement does not apply to the rehabilitation and redevelopment of a brownfield site that will provide affordable housing in s. 420.0004 or the creation of recreational areas, conservation, or parks.
The applicant’s proposal for redevelopment includes a total anticipated job creation of 50-68 jobs which are a mix of professional (salaried) and labor (hourly) wage earners.
3. The redevelopment of the proposed brownfield site is consistent with the local comprehensive plan and is a permittable use under the applicable local land development regulations.
The Future Land Use of the property is ‘Activity Center’ with a zoning designation of ‘Planned Community Development.’ The approved Development Master Plan (DMP-18-071) includes a mix of residential and mixed-use development which complies with the approved uses of the zoning district. (Attachment 3)
4. Notice of the proposed rehabilitation of the brownfield area has been provided to neighbors and nearby residents of the proposed area to be designated pursuant to paragraph (1)(c), and the person proposing the area for designation has afforded to those receiving notice the opportunity for comments and suggestions about rehabilitation. Notice pursuant to this subparagraph must be posted in the affected area.
All notice requirements of this section will be met by the applicant and documentation of such will be placed in the project file (GEN-20-170) within the Planning Division for inspection upon request.
5. The person proposing the area for designation has provided reasonable assurance that he or she has sufficient financial resources to implement and complete the rehabilitation agreement and redevelopment of the brownfield site.
The rehabilitation and redevelopment of the site is being managed by GNP Development Partners, LLC. GNP is a privately-owned real estate investment and development firm with a track record of more than $1 billion in investment, development, and asset management.
Resolution No. 2020-R-38 has been reviewed and approved by the City Attorney as to form and correctness.
