Background Information
 
On March 24, 2020, an Interlocal Agreement between the City of North Port, Florida, and Charlotte County for Design, Engineering, and Permitting of a Joint Road Widening Project was enacted to outline responsibilities addressing operational deficiencies of the Cranberry Boulevard/Hillsborough Boulevard Intersection. Hillsborough Boulevard is a jurisdictional boundary between the City of North Port/Sarasota County and Charlotte County. The Interlocal Agreement shares the project costs equally between the City of North Port and Charlotte County and identifies the funding amounts of $142,393.04 for an Engineering Study (completed) and a not to exceed amount of $300,000 for the design and permitting of the approved geometric reconfiguration of the intersection.
 
During the City Commission Regular Meeting held on February 22, 2022, the Commission approved the First Amendment to Interlocal Agreement between the City of North Port, Florida, and Charlotte County for Design, Engineering, and Permitting of Joint Road Widening Project in the amount of $97,160.00, increasing the total cost for design and permitting the intersection improvements to $397,160.00, including $8,000 for contingency.
 
The project recently received 90% design plans which indicated that acquisition of a parcel would be necessary for the placement of a stormwater pond. The owner of the parcel was unwilling to sell, and it was determined that design modifications could be made to utilize an existing City-owned stormwater pond in lieu of the pond being placed on the privately owned parcel. The redesign of the drainage configuration and permitting resulted in a cost increase of $65,780.00.
 
This Second Amendment is to fund the difference of $65,780.00, which is the amount that exceeds the $397,160.00 not to exceed amount for design and permitting of the Interlocal. The $65,780.00 amount is to be shared equally between the City and Charlotte County.
 
The total cost of the design and permitting phase for the intersection improvements is $462,940.00, including contingency. The City’s portion of the costs for design and permitting are not to exceed $231,470.00.
 
The Second Amendment to the Interlocal Agreement between the City of North Port and Charlotte County for Design, Engineering, and Permitting of a Joint Road Widening Project has been reviewed by the City Attorney and the Charlotte County Attorney and is legally correct as to form.  This Second Amendment to the Interlocal Agreement is being presented to the Charlotte County Commission for their review and approval on September 26, 2023.
 
City staff will present the Contract for Amendment One to Cranberry Boulevard/Hillsborough Boulevard Intersection Improvements Design and Permitting Project to the Road and Drainage District Governing Body for approval subsequent to approval and execution of the Second Amendment to the Interlocal Agreement between the City of North Port and Charlotte County for Design, Engineering, and Permitting of Joint Road Widening Project (Cranberry Boulevard/Hillsborough Boulevard Intersection).

Funding in the amount of $65,780.00 has been allocated in Fiscal Year 2023 Road and Drainage District Budget Project Number R20HCI account number 107-5000-541.63-00. Approval of the Interlocal Agreement does not approve the spending of these funds. The spending of the funds will be approved under a future agenda item.
