Recommended Action

 

Approve First Amendment to Construction Manager at Risk Contract No. 2023-17.005 for Construction Services Contract Phase II with Willis A. Smith Construction, Inc., in the Amount of $78,032.00, for Fire Station 86 and Police Substation Repairs.

 

Background Information

 

Due to Hurricane Ian, Fire Station 86 and Police Substation was damaged by wind and water and is requiring necessary repairs.   Staff continue to work with representatives from the Federal Emergency Management Agency, (FEMA), Rostan Solutions, Inc., and the insurance provider, Halliwell, to identify funding availability for reimbursement of this project.

Upon evaluation of the project, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The CMaR Contracting process includes the following two phases:

Ø                     Phase One:  The Contractor is selected and issued a Work Assignment for the pre-construction phase. During this portion of the project, the contractor evaluates the work required, obtains quotes from applicable contractors, and develops the Guaranteed Maximum Price (GMP).

Ø                     Phase Two:  The First Amendment to the CMaR Contract No. 2023-17.005 is for the construction phase of the process.

North Port Fire Rescue and North Port Police Department provided a direct selection of Willis A. Smith Construction, Inc. as the preferred CMaR to perform the necessary repairs at Fire Station 86 and Police Substation.  Accordingly, staff requests City Commission approval of the First Amendment to CMaR Contract No. 2023-17.005 for Construction Services Contract Phase II with Willis A. Smith Construction, Inc., in the amount of $78,032.00, for the necessary repairs of Fire Station 86 and Police Substation.

The First Amendment has been reviewed by the City Attorney’s Office and is legally correct as to form.

Procurement

 

Contract 2023-17-005 was procured pursuant to Sec. 2-406 Professional Services selection under the Consultants Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.

 

Construction Manager at Risk (CMAR) Process:

Phase One - The Contractor is selected and issued a Work Assignment for the pre-construction phase. Phase Two -The Guaranteed Maximum Price (GMP) for the construction phase was negotiated for Hurricane Ian repairs at Fire Station 86.
