TITLE: Discussion and Possible Direction Regarding the Unsolicited Public-Private Partnership (P3) Conceptual Proposal Related to the Police Department Headquarters Facility and Solid Waste Transfer Station.
Recommended Action
Discussion and possible direction regarding the unsolicited Public-Private Partnership (P3) conceptual proposal related to the Police Department Headquarters Facility and Solid Waste Transfer Station.
Background Information
During the City Commission Regular Meeting, on July 8, 2025, the Commission considered an unsolicited Public-Private Partnership (P3) conceptual proposal submitted by Florida Development Solutions, LLC (FDS). The proposal encompasses three capital projects: the Police Department Headquarters Facility, Solid Waste Transfer Station, and Wastewater Treatment Facility.
The following three motions were made during the meeting:
Ø To direct the City Manager to work with PFM, Bryant Miller Olive, and the P3 applicant to explore the P3 and COP’s, to review the concerns and questions expressed by Commission, and to bring back information at a future meeting regarding the Police Department Headquarters to include a realistic evaluation of the City’s ability to repay the amount determined as a result of the analysis.
Ø To direct the City Manager to work with bond counsel, PFM and staff to bring back details for the Solid Waste Transfer Station project comparing the cost, pros, and cons comparing the P3 process with the City conducting their own COP process.
Ø To direct the City Manager to move forward with Option 2 accepting the P3 conceptual proposal for substantive review, providing written notification to the private entity regarding the anticipated timeframe required for the City to complete comprehensive review of the unsolicited P3 conceptual proposal for the Wastewater Treatment Facility.
While the Commission has initiated efforts to further explore the P3 and Certificates of Participation (COP) processes, formal Commission action is still required to either accept or reject the unsolicited P3 conceptual proposals submitted by FDS for the Police Department Headquarters Facility and Solid Waste Transfer Station.
Per City Code Section 2-420, Public-Private Partnerships (P3), subsection (b)(5), the next step in the process is for the Commission to select from the two (2) available options:
Ø Reject Without Substantive Review: Should the Commission elect to reject the P3 conceptual proposal without conducting substantive review, the City will return the proposal review fee to Florida Development Solutions, LLC.
Ø Accept for Substantive Review: Should the Commission accept the P3 conceptual proposal for substantive review, the City Manager will provide written notification to the private entity regarding the anticipated timeframe required for the City to complete comprehensive review of the unsolicited P3 conceptual proposal.
