Recommended Action

 

Approve the First Amendment to Contract No. 2023-07, Construction Manager at Risk Preconstruction Services Contract, Phase I, with Wharton Smith, Inc. for the Fire Station 81 Remodel, increasing the agreement fees by $125,315.83 for a new total amount of $167,655.92.

 

Background Information

 

On April 25, 2023, Commission approved Contract 2023-07 with Wharton Smith, Inc., for Construction Manager at Risk Contract Preconstruction Services Contract, Phase I in the amount of $42,340.09 for the remodel of Fire Station 81. The initial plan for this project was to add square footage to meet the needs of the department’s growing administration as well as remodel and update the aging fire station. 

 

In September of 2022, Hurricane Ian made landfall and significant damage was sustained to Fire Station 81. The repairs needed, as well as the previous expansion and remodel plans, exceeded the 50% rule requiring the fire station to be upgraded to current building codes and proper hardening as a Florida Building Code Essential Facility. The fees for developing the guaranteed maximum price (GMP) have not been fully expended from the original contract due to the pausing of the project. The remaining amount of $32,015.17, from the original contract, is accounted for within the proposed fee schedule in Exhibit C of this Amendment. 

 

This Amendment updates the existing agreement with Wharton Smith Inc to include professional services required to replace Fire Station 81 with an updated building compliant with current codes, as well as design of temporary facilities for Fire Rescue personnel during the construction phase.

 

This Amendment was reviewed and approved by the City Attorney’s Office

Procurement

 

Construction Manager at Risk Contract, Phase I for Demolition and Construction of New Fire Station was procured pursuant to Sec. 2-406 of the City of North Port Procurement Code and Florida Statute 287.055, as amended, Consultant’s Competitive Negotiation Act.
