Recommended Action

 

Option 1: Approve Resolution No. 2026-R-13 as presented authorizing the purchase of real property located on North Yorkshire Street, North Port, Florida 34288.

 

City Commission Options

 

Option 1: Approve Resolution No. 2026-R-13 as presented authorizing the purchase of real property located on North Yorkshire Street, North Port, Florida 34288.

                     Pros: Secures District ownership/control of a non-standard, corridor style property to provide reliable access needed to support the operation and maintenance of right-of-way areas.

                     Cons: Funding allocated for this acquisition would not be available for other potential Road and Drainage maintenance and rehabilitation needs.

 

Option 2: Deny Resolution No. 2026-R-13 as presented.

                     Pros: Funding will be made available for other potential Road and Drainage maintenance and rehabilitation needs.

                     Cons: The District may continue to have limitations obtaining reliable access/control that is needed to support the operation and maintenance of the right-of-way areas.

 

Background Information

 

The Department of Public Works is seeking to purchase property located on North Yorkshire Street, Parcel Identification No. 1129233724. This property, listed under Tortuga Properties Inc., was owned by James Duff and, following his passing, was legally transferred to his daughter, Diane Kelly Clark, by court order dated October 31, 2008, as part of the estate settlement.

 

Unlike a typical single-lot acquisition, this parcel consists of right-of-way segments located along both sides of Yorkshire Street and Shortleaf Drive. Acquisition of this parcel will provide the District with the necessary access to these right-of-way areas to support the operation and maintenance of the drainage infrastructure.

 

A Broker Price Opinion (BPO) report prepared by Florida Acquisition & Appraisal Inc. on April 2, 2025, listed the property value at $53,160.00. Following negotiations coordinated by Florida Acquisition & Appraisal Inc., the seller has agreed to sell the property to the North Port Road and Drainage District for $6,000.00.

 

Although the BPO valuation was $53,160.00, the significantly reduced purchase price reflects the parcel’s limited marketability, as it is not a buildable lot. The Owner acknowledges this and agrees to convey the property in exchange for satisfaction of delinquent taxes and payment of $5,000.00, which the Owner accepts as full consideration for the transfer and as a complete release from any further obligations, liabilities, or interests in the property


Resolution No. 2026-R-13 has been reviewed by the City Attorney’s Office and is legally correct as to form.

 

Resolution No. 2026-R-13 was provided to the City Clerk’s Office on February 27, 2026, for signature, subject to City Commission approval.

Financial Impact

 

Funding in the amount of $6,000.00 is available in the Fiscal Year 2026 Road and Drainage District Budget, account number 107-5000-541.61-00, Capital Project R22RDD.

Purchase of property will be pursuant to Sec.2-403 (a)(3)c of the City of North Port Procurement Code - Real property, real estate brokering, or appraising.
