Ratification of Revised Emergency Order No. 2020-06 Relating to Conduct of Public Meetings by Communications Media Technology

 

Background Information

 

On March 9, 2020, Florida Governor Ron DeSantis issued Executive Order Number 20-52, declaring that a state of emergency exists in every county in the State of Florida due to the COVID-19 Pandemic.

Subsequently on March 17, 2020, the North Port City Commission adopted Ordinance No. 2020-18 declaring a local state of emergency due to COVID-19, granting emergency authority to the City Manager to issue Emergency Orders to ensure the safe conduct of necessary operations of the North Port City Government. The emergency authority granted to the City Manager during this state of emergency may extend beyond normal non-emergency powers.

 

At its regular meeting on April 14, 2020, the Commission ratified Emergency Order 2020-06 among others.  Subsequent to its ratification, the City Attorney discovered an error in Section 7.a. and 7.c. pertaining to the deadline for submitting quasi-judicial documents.  The Emergency Order has been revised to capture the correct intent, requiring that quasi-judicial document be submitted five (5) days in advance instead of ten (10) days as provided in the Emergency Order, and it has been executed by the City Manager. 

 

As this Emergency Order extends beyond the City Manager’s normal scope of authority and had already been ratified by the Commission, the City Manager requests that Revised Emergency Order 2020-06 be ratified as well.

 

The subject Emergency Order as revised was prepared by the City Attorney’s Office for execution.
