TITLE:                     Approval of Amendment #1 to Contract No. 2018-35 with Recreational Design & Construction, Inc. in the amount of $498,146.45 for the construction of an additional parking lot in support of the North Port Aquatic Center.

Recommended Action

Approve Amendment #1 to Contract No. 2018-35 with Recreational Design & Construction Inc. (RDC) and the use of approved contingency in the amount of $498,146.45 for the construction of an additional parking lot in support of the North Port Aquatic Center. The revised all-inclusive total contract amount is $10,739,930.86.

Background Information

On April 10, 2018 Commission approved Amendment #5 to Agreement No. 2011-08 with Kimley Horn and Associates, Inc. (Kimley-Horn) design and construction management services for the additional parking required to support the North Port Aquatic Center. Kimley-Horn and staff have been working diligently to complete the design documents, obtain necessary permits, and meet all requirements of the City review processes. This parking lot will have a net increase of 62 additional parking spaces for the North Port Aquatic Center. In addition to the parking lot construction, the existing walking trail will be realigned to allow pedestrian access to the pavilion, along with a connection to the parking lot.

RDC’s scope of work (for clarification, RDC refers to Amendment #1 as PCCO #12 on their support documents) includes demolition work, site earthwork, site drainage, stabilized subgrade, site asphalt paving, site concrete work, landscape & irrigation, electrical work, final cleaning, bonding and insurance. For reference this contract amendment will not impact the construction schedule for the North Port Aquatic Center facility. Furthermore, the construction of the parking lot can occur while the Aquatic Center is in operation. Upon approval of the amendment, the construction schedule will be finalized.

Staff reviewed procurement options for the parking lot construction including soliciting competitive bids or issuing an amendment to the current contract with RDC. Staff identified that (1) using RDC, who is already onsite, lowered mobilization costs; (2) RDC holds the current construction permits for the Aquatic Center and the parking lot could be added to the existing permit, whereas a second vendor would require a separate permit; (3) given current construction site restrictions, with construction equipment and materials being delivered daily, mobilizing a second vendor would result in a site crowding issue; and (4) RDC is poised and ready to begin this work upon approval of this amendment, whereas, a competitive bid process would add 90-120 days to the timeline.

Strategic Plan

Parks & Recreation: Expand access to community recreation, green space and Blueways for public enjoyment.

Financial Impact

Commission approved Agreement No. 2018-35 with RDC at the June 12, 2018 meeting, and approved use of construction contingency not to exceed $984,733.67. To date, change orders 1 through 8 total $394,447.62, allowing a contingency balance of $590,286.05 which is sufficient to offset the parking lot construction expense of $498,146.45. After Amendment #1 the contingency balance is projected to be $92,139.60. Project P17NPP is funded through a combination of Surtax III allocations (306-3036-572-6300) and Park Impact fees (152-3036-572-6300).
